Author Topic: Urgent guys got Refusel Letter........Need Help...ND QORAX n Seniors  (Read 1809 times)

   hey guys..Today i got letter that they have reviewed my application and they said that i do not meet the requirements and they are refusing my application... i have 63 points so i loose 5 for Adapatibility.. so how can i trust them to consider my app again....

          they have not given any points for adaptability ie relative in canada. and they said that i have not submitted any documents regarding proof of relationship..

* i have submitted a statutory declaration from my cousin... and his passport xerox and gas bills and telephone bills..

 so is there any change they will reconsider my application or send again my relatives in canada documents......
 
i will type what they have stated i letter......
 
you didnot submit relationship documents as proof of relations to relative living in canada. i note that there is statutory decelaration from Mr XXX ( my cousin) on file stating that you are his cousin, but i find in the doucment to be self serving and inconclusive as proof of relationship. furthermore, you stated in your schedule 3 that you have a Nice or nephew ( i ticked for MR XXX ) in canada, there are no documents on file to proof such relations in canada. no points awarded for relative in canada.. you have not obtained sufficient points so i am refusing your application


 Please Guys any suggestions or what should i do next... I thought i will be through but...No Luck...
You have to prove relationship by way of birth certificate, marriage certificate, educational document where common name i.e. parent name is appearing that confirms your blood relation

If you submitted originals than wait for another couple of weeks atleast and than you can write case specific email to ask them to return your docs. If they were copies than you won't get anything back.

As per my knowledge cousin is not treated as relative , i researched on it , i have two cousin and i did not get points as well..

You or your accompanying spouse or common-law partner has a relative, i.e., parent, grandparent, child, grandchild, child of a parent, (sibling), child of a grandparent, (aunt/uncle), or grandchild of a parent, (niece or nephew), who lives in Canada and is a Canadian citizen or permanent resident.

  hi , i also get the refusal letter, in which they mention that they are not satisfied with the residency proofs of my relative (my real sister ),so they did not gave me 5 points of adapatibility, then on 25/11/10, i sent a request to reopen my file , with this request i also sent my sister's current bank statement and ,master card bill, till today i m waiting for any response , will they respond me ?or not?

Notwithstanding the niece or nephew issue,I have to say you submitted insufficient documentation from your relative. What they usually want is : Birth certificate showing the link to your relative
Record of Landing ,Citizenship documents ,Credit card or bank account statement showing recent transactions in Canada . Furhermore your relative must have mentioned you somewhere on his forms for PR on record with CIC.

Hi

Did you submit the birth certificate of your cousin ? Thats the document which proves the relationship and all other documents which you provided like gas bills etc those are just to show that he is currently residing in Canada.

do not give inaccurate advises to people. how come someone can claim points for cousin???. did you claim 5 points for your cousin who is in canada?HuhHuh?? jesus?Huh

How you are related to your relative in canada?

Best way to prove your relation is by drawing family tree.

Family tree is very easy to understand.....

then I will see what to do next?

1st document proving relationship in case of brother or sister is Birth Certificate but it must have been issued before you applied for PR . Then his /her documents for PR and/or Citizenship etc...
His bank statement or credit card statement these must show recent transactions proving that your sister is currently residing in Canada. If no Birth Cert is available you and your sister  can send a note explaining the situation (no forgery please) .In my case my brother could not find his birth cert,so I sent a cover letter with the other docs.

hi bank statements and credit card is only to show a proof that relative is still live in canada but if its you real blood relation then they will give you other wise your relative refuse to give this confidental documents
as in my case i also claim relative 5 points and send him their pr cards copy ,their family tree chat  and also my family tree chart ,then i submit my uncle both passports canada and paki , their marriage certificate copy , his domicle copy ,my mom certificate, her marriage certificate,passport copy, my uncle citizen certificate copy,landing papers  etc
and you know what happend on later stage CHC send me a letter that your uncle father name and your father name is not matched so kindly send us additional documents, see the mistake from CHC  side  that he is my uncle so how both father name is match , he is not my brother , any way again i send him all the same documents and clearify that he is my mother real brother and send him some other documents which show that both father name is matched , it will done on aug,10 and till now there is no new update but be noted when they ask me additional relative documents they change my e status to"ïn process" now let see what happend next but the summary of all story is that they are also human and some time they misunderstand so if you think that you are right then try again or appel them

yeah they are human being making decision by interpreting the rules ,but in the end it is just their decision.
That is what I meant by sending a cover letter explaining the situation. This will help to clarify any confusion on the issues regarding  the relatives in Canada
