April-10, 2010 the process had changed to IELTS must with the 120 day's docs submission, else the VO could take a decision as he deems fit, w/out providing the applicant a second chance to submit the IELTS.
However, if u were an earlier applicant - the case would be different. Those days delayed submission (under a pre-notification letter to VO, of course) was Ok. The file used to be just kept on hold. But not now.
Nonetheless, your consultant might have written a good cover note to Buffalo. Reg. the issue. Thus, hopefully the VO might observe the older route in your case, probably.
