Dear Sir / Madam,
My name is Riya, I am from India but now in USA.  I had applied permanent residency from US under federal skiiled worker through attorney.  But I have question and i am very confused as my attorney is not guiding me.
 I had recieved B confirmation number and had submited my all document yesterday( I mean the visa office of Baffalo NY had recd by file yesterday). My 120 days will be completed on 30 October 2010. My question is I had applied for IELTS exam but got less score, so as per the lawyer decision, I had not submitted that result and wrote the letter enclosing with IELTS receipt that i will appear on 20th november ,and as i get result i will submit that result to the visa office.
 I have still 6 days left from today.
My lawyer is not even telling me the score but I took online test on website, while keeping basic score on language proficency and it shows me 64 point ( i am not aware that how much point should i give on the assesment test; it was showing none,basic, moderate and high; so kept basic to check the score)
Is it fine that i can send my result once i appear for test. Will my case not have any problem. I am very worried my attorney is not guiding me  , please can anybody help me please. Please can you help me , I will be thankfull to all.
Please help me please. I am very worried please.
 
My previous score where
listening:  5.5
Reading:  5.0
writing:    5.5
Speaking:  7.0
overall : 6.0

Hi Riya,

It depends on the visa officer if he/she started processing your file before getting your new result then vo can make a decision with the information on hand and on other hand vo can wait until he/she receives your result. Below is the chart showing how much you need in each band. Overall you need 67 points to be eligible for immigration. You can score maximum of 16 points from IELTS.

Speaking:- 6.5 to 9.0 = 4 points , 5.5 to 6.0 = 2 points , 4.0 to 5.0 = 1 point
Listening:- 7.5 to 9.0 = 4 points , 5.5 to 7.0 = 2 points , 4.5 to 5.0 = 1 point
Reading:-   6.5 to 9.0 = 4 points , 5.0 to 6.0 = 2 points , 3.5 to 4.5 = 1 point
Writing:-    6.5 to 9.0 = 4 points , 5.5 to 6.0 = 2 points , 4.0 to 5.0 = 1 point

At present you score

L 5.5 ---- 2 points
R 5.0 ---- 2 points
W 5.5 ---  2 points
S 7.0 ---  4 points

Total 10 points out of 16 in IELTS. So you can improve you result to achieve high score.

No, Not Right.
As of April-10, 2010 the process had changed to IELTS must with the 120 day's docs submission, else the VO could take a decision as he deems fit, w/out providing the applicant a second chance to submit the IELTS.

However, if u were an earlier applicant - the case would be different. Those days delayed submission (under a pre-notification letter to VO, of course) was Ok. The file used to be just kept on hold. But not now.

Nonetheless, your consultant might have written a good cover note to Buffalo. Reg. the issue. Thus, hopefully the VO might observe the older route in your case, probably.
