undertaking / illegal allien/ interpretation of Feb 2005 change of law

With luck I found this nice forum.

I am a Canadian citizen. I sponsored my ex wife and her son to Canada 6 years ago. The undertaking was still  for 10 years. Marriage did not work well. I felt I had been used for immigration and more though I know it is too complicated to prove. She left after one year of landing. At this time we started the divorce paper work in court. Unfortunately, I registered our new family car under her name (worth 35000CAD).
During her waiting period to divorce paper, apparently she met a guy in the net. She did not go into welfare although she applied for a student loan and managed her life but by stealing and using my car and all my personal belongings. I failed to reason with her to peacefully take my car back and all other personal belongings. Finally and after one year of separation we both got the divorce done. I really made it easier for her to go through the divorce issue peacefully.
Immediately after the divorce was granted she got married to this guy. I was not acting and will never do as " a jilted" ex person. But I was deeply hurt to see my own expensive car driven by a stranger man in front of my eyes.
Then I made my own search carefully and accurately to find out her current situation. I was driven by the fact that I signed for her undertaking and technically I am still responsible for her and her son till the end of period (is this correct?)
I found out that this man beyond any doubt was an illegal alien in US for long time. I have no doubt that this new marriage is for immigration purposes at least from the side of the man as perhaps she is living in her own world of love. He is from a no visa waiver country and he most probably entered US in a suspicious way.
Sice then, I have been reading all immigration Canada manuals and almost all questions in most forums. This man can never reach Canada in that short period through the normal channels. The only way I could think of is that he might have claimed refugee at the US Canada border. But to the best of my knowledge the IRB normally detain them or let them in but retain and hold their IDs. So how could he get married as quick as that and with which ID? There is no way for him to come as a S W, as he may not qualify or at least it takes years to finish. It can't be through the spousal sponsorship because she did not go to US to marry him there and even though it still could take long time to go through.
The funny thing is that she is pregnant now.
So,
1) am I still responsible for the undertaking?
2) can her marriage to me be suspicious and can this revoke her PR with deportation?
3) How can an illegal alien in US arrive to Canada as simple as that?
4) If her recent marriage is a scam for immigration purpose, would her pregnancy allow the man to be covered by the change of law of Feb 2005?
5) what is the exact interpretation of the change of law of Feb 2005? was it meant to cover anyone even the criminals or only those who were legal then simply overstayed? I am so confused?
6) Will her collaboration with the new husband open the door to revoke her PR? or is it only to do with the man?
7) what can I do?

what kind of proof did u guys have that showed ur relationship was true genuine and long lasting? its funny because many of us who really are married and/or involved for the reason of love and not for immigration purposes, we worry that we have enough proof and we worry ourselves sick over everything going exactly right, then there are people who just marry for immigration purposes. sigh how depressing. hope all goes well for u, sorry i cant answer ur questions because i am at the beggining of this process trying desperatly to be with my husband.

I am not sure if you were angry at me. I was in love and I married her genuinely. The sponsorship was done quickly with no one problem. Had she been using me? I really could not go into her heart at that time. But later after her PR was granted I felt I had been used though it was too late. Currently she is perfectly in a marriage scam, if not from her side it is from the other guy' side. This is nothing at all to do with personal revenge. Yes the system is abused widely and that is why it becomes harder on the genuine people in genuine relationships.

Now, can someone advise me please?

It's unfortunate that this kind of thing happens all the time. I do not know your religious inclination. If you are a christian, you know very well what the bible stand is in this case. Let bygone be bygone. If she was indeed deceptive in the whole marriage of a thing just to get over, she will reap what she has sown. The bible says, if your enemy hunger, feed him, if he thirst, give him water. It says by so doing you will be heaping coals of fire on his head. Don't seek vengiance in anyway. God will fight for you.
