TRV for common-law partner

I am a US citizen applying for a work permit in Ontario. My common law partner is from Brazil and was admitted to the US as a student. His I-94 is marked "D/S", but he is now outside his 6 month grace period as he has not been a student for more than 6 months. If I apply as the primary applicant, and list him as my common-law partner, will they allow him to come to Canada with me despite being out of status in the US?
