Author Topic: Travel with Student Visa during PR process?  (Read 129 times)

I am:
A US citizen
Living in Quebec

I have:
Applied for permanent residency through common law sponsorship
Applied as an outland applicant while remaining in Canada (application sent to Buffalo)
Submitted my application June 21 2011. Sponsor has been approved, PR application has been sent to Buffalo

I hold:
A US passport
A student visa valid until August 2012

I am NOT currently enrolled in any university courses.

What, if any, risk is involved traveling between the US and Canada while my application is being processed?
I understand I am able to leave Canada at any time, though if I am denied re-entry for any reason, I may be forced to re-submit my application?

Does anyone have advice, experience or insight into this scenario? There are family events occurring in the next year in the US which I would love to be present for, though do not want to endanger my PR application.

You may return to the US at any time.  Your application was Outland, meaning that your presence in Canada is not mandatory (that is for Inland applicants).

Even if for some reason you were denied re-entry to Canada, your application would continue to process as normal.

Thanks very much for the reply.

I studied full time September 2009 - May 2010. I Have not been enrolled (full or part-time) since May 2010 (though the visa is stamped valid until August 2012)

Is the validity of a student visa dependent on enrollment?

Yes, a student visa is dependent on enrollment in the approved institution.
