To have a new baby while waiting for PPR from Buffalo, need help.

My wife will have my baby born by early-April 2011 in Canada, we have done the medical exams in October, 2010 (Medical results received by buffalo in Nov., 2010).

I'm waiting for the PPR, but quite worried because the buffalo website says that a birth can change the process (If I can not land in Canada before the baby's born, I must notify the buffalo office and do not submit passports even when I get PPR in Feb./March 2011). But since my baby will be born in Canada, will it impact and delay the sending in the passport & landing process? (My I send my and my wife's passports if I get PPR just before the born of baby in this case?)

I was told by friend that I need to wait until the baby's birth certificate or passport is submitted to the buffalo office before I can send passports for the immigration visa issuance! Otherwise it will result in the cancellation of the immigration visa! Anyone has the similar experience in Buffalo? I really need help on the situation!



PS: Following is the information from buffalo's website. As pointed out in this notice, "Failure to declare additional dependants such as a spouse or children prior to your becoming a permanent resident could result in the cancellation of your permanent resident visa." And it does not say the case of a baby born in Canada is an exception.


Important notice for family members:

Do not submit your passports at this time if:

- you have married or divorced since our last correspondence;

- you have given birth or adopted a child since our last correspondence;

- you intend to get married or divorced prior to your landing in Canada;

or

- you intend to give birth or adopt a child prior to your landing in Canada

If any of these conditions apply, your new spouse and/or children must be added to your
application and be found admissible to Canada before permanent resident visas can be
issued. Failure to declare additional dependants such as a spouse or children prior to
your becoming a permanent resident could result in the cancellation of your permanent
resident visa. Once your file is closed, you would be required to submit a new
application and pay new processing fees. Any new application would be assessed
under the Act and Regulations in force at the time of its submission.

In the event that you do have additional dependants to add to or remove from your
application, you should immediately advise our office. You will be asked to submit
evidence such as a copy of the marriage, divorce, birth or adoption certificate or a letter
advising when and where the marriage, divorce, birth or adoption is expected to take
place.

thanks indeed for your recommendation once again. the above case mentioned  is similar to my case too. as you know ,  I and my spouse completed medicals  while she was pregnant. note that  for the first time ,her x-ray was not taken by the doctor for her pregnancy and after sending the medical results, in a letter, the VO requested to take the x-ray to complete the process. consequently she taken the x-ray  on november ,2010 using the safe shield for security accordingly.since then we heard no more though we had a plan to land in Canada before the baby born.we are expecting baby in the 28th April,2011.i also wrote the VO that we are expecting a child and that's why we are submitting a proof of fund as a bank statement for the three members including my child. now should i write the visa office again quoting  that i would like to add my baby in the application in the mean time? i haven't received PPR yet.please guide me with the valuable instructions in my case? should i write to the VO about it? please suggest how can i go forward with this case?

Before the baby is born how can u add him/her in your case file? U do so only if the birth occurs prior to 'landing'... before or after PPR is immaterial. U have already notified them [ditto your meds opined] that's good enough action from your end.

As it's already Feb, it'd be a hard call for u guys to 'land' & then deliver. Most likely, u'd get the PPR by Apr-11, but u'd have to delay submission of your pps due to the forthcoming delivery. 'Coz, even if u get the visa/s by Apr-11, there'd be no way that an airline will permit her flying in that precarious situation -- neither should u attempt to do so.

1&2. No, u cannot submit the pps. 'Coz if they return 'stamped' & u travel post delivery, w/out adding the baby into your case file -- u have breached the IRPA regulations... which could lead to your PR withdrawal.

It really doesn't matter as the mother is a Canadian citizen, assuming she either got it through birth or naturalization (not decent) the chid is a Canadian citizen.  She would just have to apply for proof of citizenship.
