HI..
I HAVE BEEN DEPORTED AFTER MY CASE DENIED.AND I WAS UNESCORTED REMOVAL AND THEY WROTE ON CERTIFICATE THAT I AM NON-VIOLENT AND NO KNOWN CRIMINALITY.MY WIFE APPLY SPONSORSHIP JULY 2011 AND STILL I AM WAITING FOR INTERVIEW FOR .ANY IDIA?

Hi all,

I have been deported after my case was denied. With my family were unescorted no dataine and so on. But i discovered somthing what i not really understand.

The type of our removal order is, "Departure order becomes a deportation order".

This is what i have found on CIC site: "If your departure order became a deportation order because you did not leave Canada within 30 days of the day the departure order was issued, you must explain the reasons you did not leave Canada in the allotted amount of time."

And this one from the CBSA site: A departure order automatically becomes a deportation order when someone who has been issued a departure order does not leave Canada as required or leaves Canada without confirming his or her departure with the CBSA.

Departure and exclusion orders are usually issued for less serious violations.

If a person files a claim for refugee protection, a conditional departure order is issued against them and will not come into force until a negative refugee determination decision is made. Once a departure order comes into force, the person subject to removal has a 30-day period in which they can voluntarily comply with their departure requirements. Failure to comply within 30 days of their negative determination decision will result in the departure order to be deemed a deportation order.

My question is how come that the officer marked that section? Because we showed up on time at the officer as well as on date we were deported.

Does anybody have any idea why we were treat like this and what can we do against this incorrect job they did? Because if we were get the "departure order" than we can go back to Canada and visit our family member and dont need to struggle with the stupid ARC if can get it or not, cause i heard they dont give it "cheap". Thanks for any kinde of advise.

I'm also a failed refugee and will require an ARC in order to return to Canada once our case is processed. What I was able to learn on this site is that the majority of failed refugees (or from what I can tell, ALL failed refugees on here at least) needed an ARC to return. We all got that same form pretty much, departure becomes deportation etc... (now please note that I'm basing my conclusion and answer on info presented on this forum, what I was told by my lawyer, and my own personal experience so far.)

In other words, if you're a regular visitor who overstayed, you'd probably get a regular departure order or whatever other 'lighter' removal orders exist (not 'departure becomes deportation') and won't need an ARC to return. If you're a failed refugee, you need an ARC. No way around it. If there is, I'd love to hear that story lol.
(Also, there are some people on here who claim that they didn't need an ARC to return after failing their refugee case - but please mind the date of their cases! Things have changed a lot within CIC in the last couple of years.)

Hope this clears that up. Again, if anyone has any different experience, please explain the nature of your refugee case and dates as well if possible. I'd sure be interested in learning what changes have been implemented within CIC, if any, in regards to ARCs.

Thank you Angie for the answer it's pretty clear. Actually i just thought if there is someone who has a similar experience like mine and maybe tried to appeal against that departure order blablabla and got some useable information or what ever.

You know thats suck if there is no other way to get back without the ARC if your borther and sister living there and are citizens already and cant visit them anymore, because as i investigated there is only a minimum of minimums chance to get the ARC unless you marry someone there who is Canadian citizen etc.

Thats really frustrate me and dont see any hope. :'(

Oh! Omg my apologies, for some reason I thought you were undergoing spousal sponsorship! My bad. Hmm, I have no idea how it is for people who are not under spousal after a departure/deportation order, so I've no idea what the odds are of getting the ARC are. I could swear I read somewhere that you can reapply to enter Canada after one year of being removed. But don't take my word for it- it's a lingering memory of something I read on the forums here. See if your siblings can talk to a lawyer, just a consultation (some are free, some are a small fee) and see what a lawyer says on the matter. Hope one of the senior members here have a solid answer for you. And again, good luck! =)

Thanx for the kindly words :) I just checked already the CIC page and its says that all who belong under that section of deportation type need the ARC thats it unfortunately. Couple of days before our deportation a very "kind" officer told us the same thing but no details, just something like: we can apply for the ARC and maybe we can get it because we are not criminal payed tax etc. but its not realy the truth according to the many of experiences i read that almost no chance to have it unless if have a spousal sponsor there.

Anyway thanx again. I try to figure out somthing. Blessings ;)

I got visa with copr but I have not got positive or negative arc.

I had paid $400 along with written application explaining the reason for deportation.

Now, why they just sent me visa and copr? How do I get proof of positive arc.

Please reply.

Read through all the comments here and seems like most members in here are under spousal sponsorship and can pass through the ARC pretty easily, probably because cic considers spousal sponsorship the most important and also is processed the fastest. My issue is, I have filed for parent sponsorship since 2008, which is still in process, however the dependent on parent sponsorship file is in Canada on study visa. The dependent failed the refugee claim, waiting on PRRa currently. My question is, if the dependent leaves Canada, the parent sponsorship (including the dependent) is still in process, can the dependent come back to Canada, and will the ARC be required and what is the chance of approving ARC.

i'm guessing that you don't actually need any specific piece of paper for an arc. my guess is that it was all processed, and considering you were approved as a PR, the COPR is all you need to enter. Basically the COPR outweighs any previous decision to refuse you entry, and it is giving you the permission to enter canada as a PR. I believe the COPR essentially is your "proof of positive arc". If they didn't want you to enter canada, they wouldn't have approved you as a PR.

Would this create any trouble at the port of entry as we have only single entry immigrant visas?

Dear all.
My husband applied for me on the year 2012 from Quebec.I have recently received an email from the immigration officer that I must apply for obtaining Minister's authorization to return to Canada. For this I need to submit application and bank draft of CAD 400 as Cost Recovery Fee and CAD 1500 as Removal Fee.

I am not clear whether I should send the bank drafts and my application to the visa office at Singapore or to Canada. If to Canada, could you kindly give me the address where I should send the bank drafts and the application.

I appreciate your cooperation.

I am a Canadian Citizen and have sponsored my parents' under the Family Class category. We had all been living in Canada as refugee claimants. I got my PR on Humanitarian grounds but unfortunately my parents were not so successful and were ordered to leave. They left voluntarily, without escorts, back in 2009 and paid for their own ticket. A departure form was issued to them at the airport. I applied for their sponsorship in 2010 and finally in early 2015 their file was transferred to London after I was approved as a sponsor. Since their departure order had turned into a deportation order, we received a letter that ARC submission was required for them. I submitted all the necessary documents and the ARC fees to the London office back in August. Yesterday, my immigration consultant received an email from the London office to submit my parents' passports. The email doesn't mention whether ARC was granted. Since they're asking for the passports, does this mean that ARC has been granted and they're ready to issue the visa/COPR? Thanks!

Yes Pappu they will get it Visa thats a good new for .I submit my ARC in August in Islamabad but still not approve yet.Once again congrats/

Salaam jimmy. Thanks for the encouragement. But how will I know if they have approved the ARC? In ECAS, it is showing the status as 'DECISION MADE'. In the letter we received, this is what it says:

"Your application has reached the final stage of processing. You must now complete the following actions within 30 days of the date of this correspondence so that your permanent resident visa(s) can be issued"

Btw, is your case for parental sponsorship as well?
