TFW dependents TRV and Study Permit Application

Hi to all,

Im a WP holder working under the Skilled Level B, my family applied for a TRV (wife and 2 kids 6 & 2) about a month a go and just recently received the medical request form and a letter stating the following:

Dear Applicant,

Attached you will find instructions for undergoing a medical exam. Please be advised that there is no guarantee to your application for a study permit will be accepted. However if you choose to undergo a medical exam it will expedite the processing of your application.

Be sure to return your passport once you have completed your medical exam.

If you have not already done so you MUST provide the following documents within the next THIRTY (30) DAYS:

1.   Confirm offer of acceptance from the university in Canada.
2.   Proof of sufficient funds.
3.   Police certificate from all jurisdictions in which you have resided since the age
4.   All previous educational documents (only originals are accepted).
5.   Proof of employment for yourself or your parents.
6.   If you will be attending an educational institute in the province of Quebec, you must provide a CAQ (certificate d'acceptation du Quebec) from the Government of Quebec (see Quebec Immigration).

Does it mean I have to send a Study Permit Application form for my 6 yr child?
Since my kid is enrolling in primary school, Documents 1, 4 & 6 does not apply, right?

I understand that document 3 applies to my wife who needs a  local Police Clearance, however we have been previous resident of Saudi Arabia and PC are only issued to current resident, can I send a letter of explanation about this matter?

I really need any advise from you guys, PMM , leon can you comment please.

No, study permits are only at the university level.  There is either a mistake on the application form, or the visa office made a mistake and thinks your wife wants to come to study at university in Canada.  You (or your wife) should contact the visa office and clarify the purpose of the TRV.

My understanding is that the study permit if for my child who is of school age, which makes the doc 1,4 &6  not applicable in this case.

I have check the form again and we did specify that they are dependents of TFW.

They apply for a TRV since they are from a no-visa exempt country.

CIC is not very clear on how to go about with the processing of minor children. It seems that you have to apply for a study permit for your 6 year old child.

Study permits for minor children

Many people who come to Canada temporarily to work or study want to be able to educate their accompanying minor children here. The new Act makes this process easier.

    * Under the new legislation, people who are coming to Canada to work or study do not need a letter of acceptance from a primary or secondary school in order to apply for study permits for their accompanying minor children.

For your younger child, s/he can attend kindergarten without a student permit once s/he is in Canada.

Exceptions: Studying without a study permit

In some cases, minor children do not need a study permit to study in Canada. These cases include:

    * minor children attending kindergarten;
    * minor children who are refugees or refugee claimants, or whose parents are refugees or refugee claimants; and
    * minor children who are already in Canada with parents who are allowed to work or study in Canada, and who want to attend pre-school, primary or secondary school.



So the police clearances/educational documents apply to your wife. Maybe you should also attach a copy of your WP so that they know that they are applying as your dependents.

I believe it would be useful ink to include in my letter for the study permit as to why Doc 1,4 & 6 is N/A in our case.

    * Foreign nationals who are minor children already in Canada—except those whose parents are visitors—do not need a study permit to attend primary or secondary school. However, if the parents are temporary residents of Canada in the visitor class, their minor children must have a study permit to attend primary or secondary school. Study permits for primary school students are issued for a period of one year and can be renewed.

 @  Wpholder, you got the wrong instructions.  Write to the embassy telling them the ages of your children and advising that your oldest will be attending primary school.
