Author Topic: temporary visitor visa denied- advice please!  (Read 2484 times)

Hi Everyone,
My boyfriends temporary visa extension was denied, with no reason given.  He was sent a letter that he did not meet all of the requirements and must leave Canada immediately.  He is from the UK and his initial 1 year visa ended at the end of March.  He sent in the visa extension request 30 days before hand and just received the response. He was planning on staying til September and has a plane ticket from Vancouver to the UK for this time.
I have a few questions I was hoping for some help with.

1.  If he crosses the border into the US and tries to come in with proof of funds and plane ticket, what are the chances he will be let in?  The phone answerer at CIC said that he should be let in... does anyone have any idea or comment on this?
2.  How long does immediately mean?
3.  Will this harm him in the future from coming into Canada, or immigrating here if I sponsor him?
I appreciate all and any advice on this subject!  It is very frustrating and sad as the denial was totally unexpected!

1.  If they check him on FOSS close to nil.
2.  30 days.
3.  Not if he leaves.

Thanks for your quick response!  What is FOSS? Is it something they normally check?  Also do you think if they deny him to come in, that will affect him in the future?  Thanks!

Field Operation Support System, the inland system where all actions by CIC are listed.  It should have no effect, unless he doesn't leave and is issued an exclusion order which bars him for 1or 2 years.

Asrael,

May I know what kind of temporary visa your boyfriend had that lasts 1 year? Is that a working holiday visa or simply a visitor visa? (I know that shouldn't be considered a visa cos UK citizens should require no tourist VISA to enter Canada and can stay up to 6 months like the others?)

Also, what is the reason he gave for his visa extension?

I know they refuse working holiday visa extension in most cases due to the crisis in order to protect the local workers...

I'd be interested to know the above I asked...if he was holding a working holiday visa, maybe he can simply stay as a tourist for another 6 months next time.

Hi Jaune,
My boyfriend came in on a working holiday visa.  He was here for a year and then applied for the extension for a tourist visa.. Which it seemed as he should be able to do.  But they denied it.  The reason that he gave was for having time to travel and see Canada after working for the year.  He had proof of funds from his bank account, credit card and cash.  But they denied him. 
So from the advice he has gotten from the immigration line I think he is going to leave to the US and come back in on a tourist visa.  This will give him another 6 months, but he will be leaving in September anyways... Just wants to finish off the summer here.  It sounds as if it should be ok!
We really have no idea why he was denied.

Asrael, how much should be proof of funds ?
May be he did not have enough ?

Maybe not. He had $4000 in a bank account, a credit card with a $10000 limit, and $1000 cash....
who knows.. just crossing our fingers that he will be able to come back after our trip to the states!!

Update:)
My boyfriend has been allowed back into Canada on a 6 months visitor visa.  He left Canada for 4 days and when he came back in there were no problems!  Thanks for all the advice everyone!
