I have been married to my husband since September 2009, he is a Canadian Citizen. I moved to Canada with my three children in December 2010 to be with him. I applied for Permanent Residence under the Family Class Sponsorship in April 2011. I sent all the forms required from information I gain from CIC website. I then in September 2011 call the CIC call centre to see if I could get any information regarding my application, and spoke to a gentlemen who was very helpful. He told me that I need to applied for restoration of temporary resident status. I told him that I had not seen this application nor did any document I had filled in mention this application would need to be file as well, and he told me, you wouldn't be able to find it, but he would direct me to the correct form.  He helped me fill the forms out and I paid what he said I should and sent the documents off.

I sent the application Xpresspost, which was lost by Canada Post, which I could prove with a print out off the Canada Post website. I then resent the application which was received by Vegreville on the 25th October 2011.

I have in the last two days received letters from CIC, Vegreville stating the following.

First Letter States:

This refers to your application for a Work Permit  No action is being taken to process your         
request for the following reason.                                                                   
                                                                                                     
 As a foreign national in Canada, you are not eligible to apply for an open work permit until such   
 time as you receive confirmation that your application for Permanent Residence will be             
processed from within Canada (first-stage approval).  Your application for an open work permit       
will be considered at the same time as your application for permanent residence and, if the latter   
 is accepted, the open work permit will be issued to you.  Meanwhile, you no longer have             
 temporary resident status  lease see our second letter of the same date regarding the application (p
for restoration of the temporary resident status of yourself and your three children).  You may

We are currently working on applications for permanent residence that were received in late

number; it lets people see and use information about you that is on your immigration file. To       
protect yourself, you should not let anyone else use it. When you send a letter to us, please

Second Letter Stating :

This refers to your application for restoration of Temporary Resident Status and related               
Temporary Resident documents for yourself and if applicable your family members.                       
                                                                                                       
The  entire  application  package  is  being  returned  to  you  as  we  cannot  process  your  request
because you did not include the total applicable fee of  $800.OO ($200.OO x 4). We are returning       
the  two,  unprocessed  HPM  receipts  totalling  $525.OO  (RO for  $375.OO  and             
RO for $150.OO).                                                                               
                                                                                                       
In  addition,  section  182  of the  b @ migration  and  Refugee  Protection  Regulations  states  that 
temporary resident status can be restored under specific conditions,  @ an a  is if  lication  '  made   
within 90 da_ s after losin  tem  orar  resident status.  You arrived in Canada on December 13th,     
2010, with temporary resident status valid to June 13th, 2011.  Your application was postmarked       
October 25th, 2011. As you have not submitted your application within this 90-day period that         
expired  September  11th,  2011,  your temporary resident status cannot be  restored.  The  same       
applies to your three children. Therefore, do not resubmit this application for restoration as it will
be refused

It looks like you filed an inland application. Did you submit your work permit application together with your perm residence application, IN THE SAME PACKAGE???

If yes, they have made a mistake, and you should be on implied status until AIP.

Having said that, I don't know what is required to maintain your children's status.
