Hai
I am here in canada with a work permit since 2009. My spouse applied for open work permit and got rejected on oct 2010 stating could not satisfy the visa officer that he would leave canada.
Another question ,my work permit expires in july 2011. my employer is going to extend my work permit, now submitted for LMO. my spouse wants to apply for a visit visa in june 2011 as he has vacation only in that time. Is it a risk to apply when my work permit is only valid for 2 months? he wants to come only for 20days.
 i need urgent reply

Bearing in mind that your spouse was rejected a year ago, what has changed that would convince a VO that your spouse would return to the home country now?  Change in occupation?  Provide more compelling documents (letter from present employer describing vacation leave and job to come back to?), children, family, home.  You have to address the reason for the previous refusal.  Good Luck and don't wait too long to apply if you are going to try again.  It can certainly take a lot longer than 2 weeks, depending on the reception you get at the VO.

I don't know a full answer to your question, except your suggestion about waiting until you have a two year work permit makes it sound even more like stronger ties to CANADA than your spouse's home country, don't you think?  I seems so incredibly unfair that a couple cannot spend their holiday time together.  Here you have VO making everyone go through hoops to prove they are in a committed relationship when getting PR, and here you are unable to be together legitimately. I am sorry and hope you are able solve the problem. I think the answer may be staring at you all the time-the vacation period is only a few weeks away, so you really have no option but to act now.  All the Best!

You have to say what is TRUE.  If your papers DO EXPIRE you will both be expected to leave the country.  If that was the case you could write that he wants to come to help you return home.  As you KNOW your contract WILL be extended that isn't the truth.  You have to find a way to convince them of his ties to home country.  What will sound best for that?  Have you managed to get docs from his employer?  Proof of property ownership, family etc?
