Spouse Sponsor-Visit Visa Canada-International Student USA {HELP}??????

Hello everyone,

- I am an international student in USA and my visa is expired but my status is legal and valid in USA since im still in school.

- I can travel outside USA but in order to get back into USA i require a visa so I preferred staying and completing my education.

- My spouse is a Canadian citizen, we sent in our application last week so it can be processed in Buffalo NY. She is a full time student and works full time so she cant travel for a long period. 

-  Questions:
1. Can I apply for Canadian visit visa while my file has just been sent for process last week (9-Sep-2009)?
2. I will not be able to show proof of returning to USA as I will require visa to enter USA...
3. What is the best possible solution for my situation so I can be with my spouse other than waiting for the application approval?
