I just got a letter today from the Canadian Embassy in our country.

I just got a letter from the Canadian embassy, this is what it says:

Based on the information provided in your application, I am not satisfied that you have established that you and your sponsor are conjugal partners. A conjugal relationship is defined in the immigration policy manuals as a "marriage-like" relationship.

Specifically, it does not appear that the characteristics of a married or common-law relationship, such as (but not limited to) joing financial arrangements, joint property holdings, and evidence that the relationship is long term and physically, emotionally, financially and socially interdependent.

However before a final decision is made regarding your application this letter is being sent to you to provide you an opportunity to respond to this concern by way of written submissions. Please be aware that the onus is on you to satisfy a visa officer that you must meet the requirements of the Immigration and refugee protection act and regulations.

Any additional information you would like the officer to consider must be received by our office within 45 days of the date of this letter.

We submitted a letter from the bank that me and my partner have a joint account,proof that he is extension of my cc, certificate that I am a beneficiary to his insurance, itinerary of our trips together, western union receipts, letters from our family, pictures of us with our families, copy of tickets that he has been visiting me. Chat, skype logs, magic jack call logs, his phone bills, our text messages we took pictures direct from our iphones.

I don't know how else to prove it. Please help me.       Is this even considered the interview? Or is this better than an interview?

Take a look at pages 19-22 (or 20-23 of the pdf version) of OP2 to get the details of how your application would be reviewed.  You can find it at http://www.cic.gc.ca/english/resources/manuals/op/op02-eng.pdf

Quote
The word “conjugal” is not defined in legislation; however, the factors that are used to determine
whether a couple is in a conjugal relationship are described in court decisions.
...
In the M. v. H. decision, the Supreme Court adopts the list of factors that must be considered in
determining whether any two individuals are actually in a conjugal relationship from the decision of
the Ontario Court of Appeal in Moldowich v. Penttinen.
...
From the language used by the Supreme Court throughout M. v. H., it is clear that a conjugal
relationship is one of some permanence, where individuals are interdependent – financially,
socially, emotionally, and physically – where they share household and related responsibilities,
and where they have made a serious commitment to one another.
Based on this, the following characteristics should be present to some degree in all conjugal
relationships, married and unmarried:

• mutual commitment to a shared life;
• exclusive – cannot be in more than one conjugal relationship at a time;
• intimate – commitment to sexual exclusivity;
• interdependent – physically, emotionally, financially, socially;
• permanent – long-term, genuine and continuing relationship;
• present themselves as a couple;
• regarded by others as a couple;
• caring for children (if there are children).

People who are dating or who are thinking about marrying or living together and establishing a
common-law relationship are NOT yet in a conjugal relationship, nor are people who want to live
together to “try out” their relationship.

Persons in a conjugal relationship have made a significant commitment to one another. A married
couple makes the commitment publicly at a specific point in time via their marriage vows and
ceremony, and the marriage certificate and registration is a record of that commitment. In a
common-law or conjugal partner relationship, there is not necessarily a single point in time at
which a commitment is made, and there is no one legal document attesting to the commitment.
Instead, there is the passage of time together, the building of intimacy and emotional ties and the
accumulation of other types of evidence, such as naming one another as beneficiaries of
insurance policies or estates, joint ownership of possessions, joint decision-making with
consequences for one partner affecting the other, and financial support of one another (joint
expenses or sharing of income, etc. When taken together, these facts indicate that the couple has
come to a similar point as that of a married couple – there is significant commitment and mutual
interdependence in a monogamous relationship of some permanence.

Thanks sis yes I was aware of those things kaya we submitted everything that we can we have joint accounts, beneficiaries of insurance, he is the extension of my credit card, letters from both our family and friends. We've been reading how conjugal partnership again and again even before we submitted our app para we know what we were getting ourselves into. Kaya nga di ko magets ano pa. Ni hindi ko alam kung mas maganda ba ang explanation letter or interview.

Hi

Got my visa today. dropped by the emba this afternoon. My meds gonna expire on Aug.12 .Im not sure if this is something but when the guy handed me my visa he told me "..pero sinabi namin kaysa iparedo mo since nakabook ka nanaman ng flight sayang naman" so Im guessing its either bolero lang talaga si sir or that they really do make an effort to give us a positive result. I'd like to think its the latter.

I dont mean to give false hope or something but I know that when I was waiting, It was like hell and reading something that is similar to my case that got a positive result gave me some optimistic-maybe-in-denial relief  Smiley . But now that I got my visa. Its all good. You'll get yours very soon I think.

Thanks Sir Bolero from Emba

Cheers,

P.S. 0jenifer0 - salamat sa info. very detailed. much appreciated. Smiley

Well a big congratulation to u..What time they called/phone u that they approved ur visa last july 26..Usually they r not so strict on men applicant unless u have military background..And beside ur both filipino couple they knew the culture. That why ur quick.
