hello,

I wan't help. My husband just died in canada and i am still here in philippines. Do i still have the chance to go to canada? my husband didn't filed my paper for residence before he died but he filled out and signed all the paper works. i would like to ask if i could continue the paper work even if is already gone. let me know please. i need help!!!

No - since your husband has passed away, you no longer qualify to immigrate as a spouse and can't continue with the paperwork.

If you are still interested in coming to Canada, you should start looking into how you can qualify to immigrate independently (i.e. skilled worker class).

Your husband can stop the sponsorship process by sending a letter to the CIC. I'm sorry - I don't know how you would be informed if this happened.

Your medical is valid for 1 year so no need to take another one at this point.  On the email your husband received, it should have a Client ID.  He can use that to search on ECAS or he can use the receipt number generated on the fees receipt if he paid via the online method.

Thanks Leon for your prompt response.....I am still new at working this site and so just saw your message. For updates:

1. I couriered my spouse application from outside Canada on the 15th of May 2011 and it was recd at their Mail room on 19th May.

Now am eagerly waiting for a response from them. From the processing times it shows they are only working now on applications recd on 29th Apr!!! Does that mean it will take a real long to hear from them? WHat do you think would be a good approximate timeframe to hear from them?

Thanks and hope n pray all goes well for us !

Currently says up to 41 days for processing.

Mine arrived the same day as yours so we are only at 18 days and counting. Almost half way there  Cheesy

Anybody know why my wife's visitors visa was rejected, the reason CIC gave was "they did not think she would leave at the end of her stay". We are both in Rwanda and have a 2 month old daughter. She's been to Canada in the past on a visitors visa as well. Not sure where things went wrong. Thanks!

Because she now has ties to Canada (you and the baby) that they feel were not overcome by the evidence you presented that she would return home.  It is basically standard procedure to deny TRVs to non-visa exempt spouses of Canadians, they are considered high-risk for overstaying.

this all sounds good, but can please someone recommend whit what start in this situation??

On the 12th of August, 2009 I left Latvia to go to Canada, using the visa issued for one year stay. After 2 months I met one Canadian citizen and after another while we decided to move in together. On the 11th of August, 2010 we decided to wed. After public information we understood that I do not have to leave Canada, but I can apply for permanent residence. At the beginning we tried to fill the documents ourselves, but realized that without a professional help of a lawyer it will be impossible. That is the reason we started to save money for legal services. In the meantime my husband got sued for physical abuse to another person (but not to woman or child), which resulted in his job loss and he had do apply for State support. So far we understand even if my husband will not be sentenced, he is not allowed to sponsor me until he has paid back the social state support.  And then if my husband will be sentenced he cannot sponsor me.

On the 18th of May this year I have returned to Latvia, because I can work here, but without a permission to stay I am not allowed to work or study legally in Canada.

I would like to admit that our marriage is not fictive.

I would appreciate if you could help me with following questions:

 
1.      Is it allowed for me to visit my husband without the permission to stay? If yes, what documents do I need to present?

2.      If my husband gets sentenced, is he allowed to sponsor me, with the aim to get the permission to stay? If he is, we would apply for the permanent residence from Latvia, which would result in no deed for my husband to sponsor me anymore.

3.      Is it allowed for my husband's family or other relatives to sponsor me?

4.      Am I entitled to apply for another way of permission to stay, with the objective to be with my new family?  Sad Cry

Why would they not let me support and remove my daughter and wife in a 3rd world country? Current waiting time is 31 months for my wife, my daughter won't even know who I am in 3 years. How is this even possible?! How can you deny a father from his child?! A wife is one thing and I understand, but a child?! Please tell me how this is fair and just and if there's any other way to get around this?

I can't answer those queries for you.  I can only tell you to get started on the processing for permanent residence for your wife, and apply for your baby's citizenship if she inherits it from you (provided you were born in Canada, she can inherit it).

Remember that the timelines presented on the website account for 80% of all cases, some take less time, some take more.  A well-put together and fully documented application can reduce (to some extent) the wait time.  Also, pay all the fees associated up-front, this can also shave some time off the processing.

There are plenty of us who understand where you are coming from.  You will find lots of information here, and support from people dealing with the same embassy is quite often present as well.

Going to try a few mp's and call in many overdue favours and hope for the best, keep ya posted on a slim chance to move my wife/daughter over, oh and btw, I have already processed my daughter over for citizenship, thanks! I will go back to the embassy in Kigali and plead our case again...
