Hi everyone,

Just a general question that has had me wondering.

I've recently applied inland and my husband is sponsoring me. I've had my medicals done and sent everything off. After reading a few threads in this forum, I've come to realise that I will more than likely be requested to get my medicals done again, as the first stage processing time at the moment it up to 11 months.

So I'm wondering, if medical results don't really matter under the spousal sponsorship class - then why do they make us do them again?

Just seems odd...

It's not that it doesn't matter, it's than an exemption is made for spouses.  If you had a communicable disease, they would still want to know about, and exempted spouses can still be placed under medical surveillance if necessary because of an illness that might be danger to others.

The validity of medicals for Inland applicants may be extended, because the applicant is expected to remain in Canada.

Hey guys,
Just a quick question about my application, I'm pretty sure I left some blank spaces on the forms instead of witting N/A, how bad is that? But I remember that in some parts I did write it.
In the worst case scenario they would return the application, I would fix it and then submit it, meaning that I gotta wait another 66 days for them to process it??

Thanks in advance Smiley

Leon,

Thank you for your reply to my question. To follow up on your reply..

If you get married in Mexico and she then applies for a student visa, she risks being refused because she has a PR spouse and might be planning to overstay.  If she applies for a student visa before getting married, I think she has a better chance of getting it.  You do not have to apply inland even if she is in Canada.  You have a choice of outland too.  Mississauga currently takes 68 days to approve you as a sponsor, and after that, Mexico is taking 14 months to process 80% of the cases.  If she is legally in Canada on a student visa, she could also opt to be processed in the US which means if she is called for an interview, she needs to be able to travel to the US but the processing time is shorter there or 11 months for 80%.  You can see timelines or real cases at trackitt.com

Please, tell me if it is possible then to get married in Canada while she is there on student Visa? How long after she enters Canada on a student visa can we apply for a marriage license? This is just to estimate how long can she remain in canada on a student visa.
Can we then start the spousal sponsorship app process outland through the US while she waits in Canada?

Thanks!

Yes, you can get married in Canada to a person who is on a student visa.  I do not know of any limit how soon you can apply for a marriage license after she enters Canada.  She can remain in Canada on a student visa until it expires as long as she is still studying.  If she wants to change her status, say to another study program or quit her studies and change her status to a visitor, she can apply for that.  She can also do that if her student visa is about to expire.  Spouses being sponsored that are in Canada are usually granted a change to visitor status or an extension of it but if you are smart, you apply to change her status by mail because it will buy you more time.  Until you get an answer, she is under implied status and can stay in Canada and processing if you apply by mail takes around 4 to 5 months.

If her student visa is issued for at least a year, you can apply outland through Buffalo.

CPC-M is still working on applications received up to July 20.  Count 68 days from Aug 16, you arrive at 21 Oct.  You have another 3 weeks or so to wait for sponsor approval.

Does anyone happen to know if you can apply for spousal sponsorship for 2 countries?  I am currently on contract in the UK and the process for getting a spousal visa is very fast...almost immediate...so we wanted to do that at the same time as applying for the Canadian spouse visa so we can atleast be together while I finish the contract and we wait for the Canada visa.

Sure you can apply for both.  The only problem I can see is if Canada immigration and UK immigration share information, Canada immigration may not want to grant a PR to your spouse if they do not believe you are coming back to Canada at the end of your contract.
