MY FRIEND GOT HER ADVISORY ON MARRIAGE AT NSO AND SHE FOUND OUT HER HUSBAND WHO IS A CANADIAN CITIZEN HAS BEEN MARRIED HERE BUT THEY GOT DIVORCED IN CANADA, WHAT IS THE BEARING IF THEY PUSH THROUGH WITH THE SPOUSAL APPLICATION?

Married 9'06, ap sent 3'07 & refused in 1'08 due to inadmissible son.  Won appeal 1'10.  Back in process 4'10, new meds req 5'10 - submitted in June.  New FBI submitted 8'10  Approved 30Nov2010! COPR recd 05Jan2011. LANDED 31Jan2011 YAY!

Is your friend already married to the Canadian? She should have known that he was married to another Filipina during the application of marriage license, it will show in Certificate of No Marriage from NSO

I am not sure how the ruling goes, but if their marriage is legal here, then it would be fine. Let her find out if their marriage is legal in the Philippines.

Canadian citizens(natural-born or naturalized) are not required to get a CENOMAR from NSO. Only the filipino fiancees are required to get CENOMAR. Foreigners only has to meet certain requirements .It is in the discretion of the local civil registry who is issuing the marriage license to require the foreigner to get a CENOMAR from the NSO- although  I heard some places in  Cebu, Philippines which  require CENOMAR  as a corrective action to "bigamous" marriages entered by foreigners-  but again that is not applicable to all provinces in the Philippines.
Another loophole of the Philippine law, making some marriages void from the start.

My husband is Canadian but then still our local registrar asked for his CENOMAR issued by NSO. At first, I was like, are you sure? And they said, yeap, to make sure that my husband,my then fiancee is not married to another Filipina.

You are right, this procedure should be applicable to all provinces to make things right from the very start.
