Hi,

I am a Canadian permanent resident and currently I live in Philippine. I would like to sponsor my husband and my 1 yr old kid. My kid has a Canadian visitor visa and I am planing to move Canada with my kid. I would like to sponsor my husband and my kid through OutLand process. I do have few questions based on Mr.Leon's sticky post.

1. I have lived more then 2 years outside Canada. When can I apply for sponsorship? I mean, do I have to wait some minimum days in Canada before applying OR can I apply the next day after my arrival?
2. It seems the processing time is approx 12 months (2 months in Mississauga and 10 months in Philippine) to sponsor my kid and husband. I think my kid is can stay in Canada in visitor visa up to 6 months only. Does my kid can stay with me after 6 months? OR should I have to go back Philippine and wait until she get immigration visa?
3. Does my kid has to go thru Medical requirements on assessment notice?

Please advice.

Thanks,
Sampaguita

1) You may apply as soon as you are resident in Canada again.

2) You would have to apply to extend the child's visit period.  You may not reside long-term outside of Canada while sponsoring your family as a PR.

3) Yes, the child must be examined medically, even though it is a baby.

Hi CharlieD10, thanks for the reply.

#1 - Is there any possibility on visa extension rejection by Canadian embassy for my kid? What are my options if the visa extension is rejected?
#2 - Once the sponsor application is processed, should I have to go Philippine with my kid to get immigration visa stamping. Please correct if I am wrong.

Thanks in advance.

1) It's a small child, you are the mother, it would be unlikely they would refuse to extend the visit period as long as you make the application properly and provide the necessary information.  Your options are to take the child back to the Phillipines to his father and return to Canada so you can remain eligible as their sponsor.

2) You can take the child, or send the passport to the father (if this is legally possible, some countries don't allow you to send their passports internationally), since you are sponsoring them both.  There should be no issues for him to submit the child's passport along with his.
