Thank you.... and WOW... ok... so now I have a better understanding of the situation. I am not sure there is much hope either, under spousal sponsorship anyway. Aziz... could you not go back and finish your last year of school. Then apply for a work visa? Or student visa? Then reunite with your wife this way?

I just read the whole thing! I did not know there was such an important age gap. He was 18 when he proposed marriage! He was a kid!!!!
And now I understand why the visa officers were skeptical about their relationship being genuine. I am skeptical too now.
Yeah me too! Just reading about the whole thing is making my head spin. I can only imagine the how the VO must have felt, to not only take note of the nitty gritties but make a decision based on it!

I followed rjessome's lead and read it last night. It scared the crap out of me re: the stuff we put in our application. I would agree that between the "fabrications" that the couple had to fess up to and the inconsistencies and lack of knowledge in the answers which CIC judged was due to miscommunication and lack of meaningful communication at best, one could see why immigration made the decision it did. But they nitpicked over whether Aziz knew exactly when his wife moved into her current place (he said two or three months but it was six or more). But the calling card cutting out multiple times during the hearing interview (I think it was).....come on, dude, you couldn't have found a secure line?
The point I was trying to make in my comment after reading the case is it shouldn't matter if they were nitpicked or not. Their answers should have been PERFECT. Appellants typically have at least a year to prepare for an appeal hearing. If there were ever a time to study about your partner, it would have been during the time they were waiting for the hearing. It seemed to me that the IAD member was prepared to overlook the age difference as long as genuineness could be proven. They discounted the VO's remarks about a "non-traditional" Moroccan wedding and didn't give that any weight. All the couple had to do was prove that they knew each other the way a married couple "should" in the opinion of the IAD member. That was a gift. But it required near perfection on the part of the sponsor and applicant and 100% honesty. They didn't deliver. The member was even prepared to forgive the lie told in the application about how they met but the applicant and sponsor didn't produce a similar position on that point which ended up being another strike against them. Put yourself in the IAD member's shoes. You are willing to look at this from a fresh perspective, the sponsor owns up to a lie and makes a plausible explanation, you are prepared to forgive but when you question the applicant about it, they perpetuate the lie. I mean, if the couple hadn't even discussed that they were going to disclose this at the beginning of the most important hearing of their relationship, wouldn't you call into question how much and at what depth they really communicated? I'd get a little nitpicky too. Aziz, I'm sorry akhoya but I don't want to see your application. I do this work as a profession and I come on the forum to help people out where I can, not take over their case. Even if I was hired to do this it would take a huge amount of work and I give you less than a 25% chance of success. I do wish you and your wife luck. Sometimes the universe is strange and if we work hard enough for what we want, we get it. And sometimes we just get lucky.

hi thanks all for supporting replies it really cheers me up i was feeling down yes i can finish my last year of education guess why i left my school on 2007 because i was having so much hopes going to canada and build future there with my wife and her family, but the good thing here in Morocco you can finish your high school education whenever you are ready, and now i registered in british council IELTS TEST its on 08/10/2011 at 8 pray all for me so i can immigrate or get job with this IELTS do you think this is good ?? also i am applying to Morocco government to finish my last year of education, rjessome can you give me your phone number ? i like your message and would like to discuss some things many thanks all of you.

They used a lawyer. He or she should have picked up on all the inconsistencies during consultations and push them hard to be in sync in terms of their knowledge of each other. On the other hand, may be he or she did. I wasn't there. It is the responsibility of the couple to educate each other about one another. It seems this was taken lightly despite the magnitude of the impact a failed appeal will have in their lives.

You need to finish high school, get a trade certificate (plumbing, mechanic, electrician, etc.) or a university degree AND a few years of work experience before you can look at immigrating under one of the economic classes. Taking IELTS now will not do anything for you.
