I have to see reality.  I am going to be 49 in June.  My husband is going to be 30 this summer.  If we appeal, we have to wait 2 more years.  Then, if we win the appeal, we have to re-apply for visa.  Another year.  I will be 52!!!  And I don't have $5000 to appeal


I know the appeal can be lengthy... but I do not believe you have to reapply for the visa?? Or I could be wrong.. maybe someone more senior can answer that....

No.  If you win the appeal you do not re-apply, the visa office is directed to continue processing the file as is.  It might go to CPP-Ottawa, and they could either finish it there and direct Rabat to issue his visa or else they will send it back to Rabat to be finished, it depends on the security and background concerns.

And in order for her to make a successful appeal, if that's the road she chooses to go down, she needs to know the specific reasons the immigration officer was not "satisfied" that their relationship was genuine and not solely for purposes of the foreign national immigrating to Canada. Without something more specific than "not satisfied with our relationship. She believes my husband is using me for entry to Canada," (not sure if they're not even required to elaborate on that in the refusal letter) and absent the GCMS notes, Habibti does not have much of a clue as to why the IO made the decision she did, so how can she disprove those arguments? In any case, my heart goes out to her because this was a huge emotional and financial investment.

Yes, I guess the first place to start is the GCMS notes. This will give you (Habibti) a much more detailed reason of the rejection. Then you can go from there to see what your next step may be.

Ok... then one year to get a date for the appeal.  And how long after that?  I am full of debts.  I would have to represent myself if I change my mind about giving up on my marriage.

How is it possible that ONE PERSON!!!!   ONE F........G person! decides to break all our dreams, our hopes and life projects!  I invested so much, I sacrificed so much, I worked too hard, I suffer too much, I endured so many things,  to have ONE PERSON to swat it all with one hand.

My husband right now is completely lost.   I talked to him on the phone and he is under shock.  He does not know where to stand.  He was kind of frozen with me on the phone.  However, later on, when my mother called him, he said how angry he is.  He got discouraged when I told him it takes years and money to appeal.  He said he will work to earn enough money to find a way to be with me.  I told him to give up on me and he said he will love me until the end of times no matter what.  There is lots of confusion right now in his state of mind.

I said the same things even before I went to marry my husband. I don't understand it either. It's not like they can see us everyday talking, planning, dreaming, crying, loving each other.

I really have a hard time with this whole process.

But now is not the time to make rash decisions either. Take some time and talk with your husband. It is better to make a big decision like ending the marriage after some time and discussion.

Just contacted my MP office to get the notes.  Once received, we will see from there.  I just feel crushed.  As if life got out of me completely.  When I got the news, my legs gave way and I felt I was going down a long dark hole.

Djinna, at this juncture these notes are the last thing you need to worry about. If you have yet to submit your application, you obviously have to concentrate entirely on that application and all of its minutiae....the forms, relationship evidence, police certificates, medical exam, fees payment, etc. And even after you've checked, double-checked, and perhaps even triple-checked all of your documents, and dotted every i and crossed every t as far as the instructions go, and you've sent it in, you have a wait of a couple of months for Mississauga to approve you as a sponsor before the PR portion even gets to Rabat. Those notes won't have anything important in them until at least a month or two go by after they've been delivered to the visa office. So basically, you're waaaaay before that step.

Thanks again for everything and im just trying to make everything perfect and hopefully everything will go smoothly in cha Allah. Smiley

Habibti, don't say you are angry at God, He wants always the best for us, we just had to believe in him in hard and good times and you never know what will happen. Smiley

Never give up on life cuz i did last year and hamdoulilah im here now and happy and wtv will happen with my sponsor, i know God wants only the best for me and my husband.

Habibti I am so sorry for this terrible news. Could you put the paperwork in motion for an appeal, and decide whether you want to pursue it later? You are rightfully very upset right now. Take sone time, talk with your husband and make the decision together. Good luck to you.
