Skilled worker application - but children from 1st marriage father unknown statu

I am going to enter the immigration process under the skilled worker programme. I am a register emergency nurse from the UK. I have two children from a previous marriage and one child with my current spouse. If i can't locate my first husband to ask his permission to take my children to Canada what can i do? If i do locate him what legal document does he need to sign if he is willing for me to take the children to Canada?

Any advice would be greatly appreciated than you

Get a custody order from the British courts.
