Hi,
My sister applied for permanent immigration as principle applicant in 2007, the timeline given was 48  months which is approaching in MAY 2011. But there is family problem with my sis now. she is married and have two kids, 10 and 8 years old.

She does not have good relationship with her husband any more cause he is involved with other womens and all the wrong doings. she is having hard time and even he is brutal with kids too (just to let you know its in pakistan which is male dominant society).

Now she wants separation but she thinks it will affect her immigration process and children custody. IS THIS THE CASE? please advise. and can her husband be eliminated from immigration as her dependant?

If they separate (even if she is not legally divorced) she should inform the visa office processing her application. He can be removed from the application. However, she can only immigrate with her children if she has his consent, or is granted full exclusive custody by the courts. If he has shared custody, or does not consent, then she won't be able to bring the children with her to Canada. She'll need to finalise her separation and any custody arrangements before her immigration application can be finalised.
