Author Topic: Seniors pls help !!!!!!! Adding spouse in the application  (Read 366 times)

Hello Friends,

I am in the process of adding my husband to my application.

My marriage with him is his second marriage due to which his passport has his earlier spouse name..

He went to the passport office to get that changed to my name.
& he was demanded the original copy of divorce deed. Though he has attested copy of the final judgement.
The original copy of deed was submitted in the court.

Now I am stuck.

I am the Principal Applicant & he is included in my passport as spouse.

Shall i add a covering letter explaining everything?
Or
Submit a affidavit...

Pls suggest...

Hello Friends,

in my view, covering letter will be good enough for clarification. Do attach the copy of deed submitted to court as an evidence.

But we dont have original deed as it was submitted in court.

Copy received by court is good enough. Better get it notarized. Will work. No need of original

Deed is the document that substantiates your explanation in formal letter to CHC. Do not worry. If CHC needs more insight, they will contact u

Hi Khanak,

I feel this might be a problem,coz as u r planning to include him in ur application,u have to provide his passport copies and if the spouse name section of his passport shows his ex-wife's name then the VO would be confused and they would request for more clarifications and at that time u are going to be in deep trouble.Even if u think of showing the attested copies of divorce deed,the VO might still request u to clarify why ur husband's passport is holding his ex-wife's name and not yours.Also,at the final stage,we are supposed to submit our Passports for stamping and the person who is going to verify our passports will be a different one and they are going to come up with the same query.
This is just my suggestion,its better to find the possible ways to include ur name his passport coz this is going to save u from getting into trouble during the entire processing stage.Wish u find a solution soon.

Write an affidavit to the passport office explain the situation in the affidavit also stating that the original deed is with the court, try to get the affidavit attested by the concerned judge or court official and request them to state/ write in the affidavit that they hold the original deed.
Then go to the visa office. I am sure this will work.

The length of time it takes to process applications varies depending on where you applied.

You may be able to avoid unnecessary delays by:

    * making sure that all the necessary information is included with your application
    * notifying the visa office of any changes to personal information on your application, such as your address, telephone and fax numbers or a change in the makeup of your family
    * avoiding repeated inquiries to the visa office
    * following all instructions from the visa office in a timely manner
    * ensuring that the photocopies and documents you provide are clear and legible, and
    * providing certified English or French translations of original documents that you submit in other languages.

Your application will be delayed if the office processing it has to take extra steps to assess your case. Your application will take longer if:

    * there are criminal or security problems related to your application, or if additional security background checks are required, or
    * your family status is not clear because of a situation, such as a divorce or an adoption that is not yet complete or child custody issues that have not been resolved.
