Hi! Hope someone could help.

My husband and I (under spousal open work permit) applied for restoration and WP last january 25, 2012 (our restoration period will end on March 13, 2012, our WPs expired Nov. 2) because we were advised by our new employer to do that (we were expected to use my husband's contract from his current employer at that time). We assumed that we just needed to file for restoration but the online application asked us to apply for a work permit as well (thus, making us submit my husband's contract from his current employer). We expected this WP application to be refused since we don't really have an LMO from my husband's current employer.

The thing is, our new employer's LMO arrived January 31 so that's the time we applied for an online application for work permit for this new employer. During the online application, the system did not ask us to pay for restoration. We assumed that the reason for this is because we already applied for restoration 6 days before.

We received a refusal letter last Feb 10 for our first application. Now my question is, what will happen to the 2nd work permit application when we weren't asked for payment for restoration anymore? Will they deny the work permit application because the restoration of status was already processed days before? Won't they see our transactions and just recognize the restoration on the previous application?

I do appreciate any views on this.
