Author Topic: Requested Buffalo to transfer to Brazil and nothing from them yet!!!2 months!!  (Read 972 times)

My sent my application to Buffalo two months ago requesting them to transfer my file to my home country and they have not replied yet. I e-mailed them and they said my file was under review in regards of the transfer and that they would contact me as soon as possible. What's going on? Isn't it taking too long for them to decide to whether transfer my file or not?

I want to apply for Canadian permanent residence in the Federal Skilled Worker (FSW) category. Where should I send my application?

All applicants in the Federal Skilled Worker Class must submit their initial application to the Centralized Intake Office (CIO) in Canada as of April 1, 2009
Should I send the fee to the CIO as well?

Send your processing fee to the CIO, but do not submit the Right of Permanent Residence fee until it has been requested by the Visa Office.
I live in the USA and want to apply in the FSW category. How can I pay my application fees in Canadian dollars, as the instructions require?

Most private currency exchange businesses will issue money orders in Canadian dollars.

You may also wish to check with the bank in the USA with whom you have an account. Some banks in the USA will issue Canadian dollar certified cheques or bank drafts for their clients.
Should I send all my supporting documents to the CIO too?

Send only the documents listed on the CIO checklist: PDF* (87 KB)
Will the CIO issue my permanent resident visa?

No, the CIO simply examines your application to see if you appear eligible to apply in the FSW category. If you do, you will be advised to submit your full application to the Visa Office. Before processing begins, the Visa Office will review your application to ensure you meet the residency requirements to have it processed there.[/color]

I posted the above information I derived from CIC Buffalo site just to confirm to you that in case you cannot provide 1 year of continous legal stay in USA they will automatically transfer your file to your home country. We have the same situation MJSantos the only difference is that when my lawyer received the complete package back from Buffalo they did not waste anytime to send it back to them but instead what they did is they emailed CIC-NS and CIC-Buffalo to transfer my file in Manila as we cannot provide residency requirements.  They send my full application to Manilla and I am now waiting for my new AOR, it's only 2 weeks past and I think waiting time will be 60 to 90 days.  Let's hope for the best.  Goodluck to you and Thanks Rupesh for all the good comments.

Hello,

I am working in US legally, and has a legal stay of more than one year, I would like to apply for Canadian Visa under FSW, I have two question 

1. whether I can  apply in US for the same, knowing that my stay period is limited to 6 more months in US & to which consulate the same is to be applied. What would be the adverse effect, in case the application needs to get transfered my country India ??

2. The Transcript that needs to be submitted, can be procured for Canadian consulate one address say seattle, WA , but if submitted to another on transfer of visa, would that be accepted as valid.

Sorry to MJSantos for hijacking your thread.

if you visa originally allowed you to stay for at least a year and its not a visitors visa, you can apply to buffalo, even if you have few months left on the visa. If you apply in the US and you don't the CA visa before your US visa expires and then you are asked to come for an interview, then you'd have to get a visitors visa to the US. Also you are not allowed to send your passport out of india by mail.

You have to submit the transcript. It doesn't matter what it says on the envelope. If you are going to apply through the Buffalo office, let it say buffalor office, don't worry about it being transfered to Seattle.

have not heard from anyone on the forun till date that they have received the refund. In fact, there's a thread for ppl who have been waiting for the refund for over 3 months. I'll recommend that re-sending the application to CIO NS will put you in the back of the queue. So, it's better to write an e-mail to Buffalo and ask them if they did something on you request for transfer of file.

I don't know. It may be faster if brazil is processing faster than it would take if Buffalo has to look at it first before transferring it. I think refunds take a long time.

MJSantos,

Don't withdraw your application.  You already passed the stage one and right now waiting time for first stage is almost 2 months so why not wait for few more months on whatl Buffalo will do.  What I know is if you cannot provide proof of residency requirements in USA they will transfer your file to your country of citizenship.  I think and I read in one of the column here that waiting time for this is 90 days.

As what I told you earlier we are on the same boat but my Attorney instead of resubmitting my file to Buffalo, they emailed them to inform that they will forward my file to my home country as I can't provide proof of 1 year of legal stay.  Patience is the key word of the game here.  Let's just wait but everything is still up to you.  Goodluck.

I guess Alpha Romeo is right and patient is the key. Even if I withdraw my application, I still need my documents back from Buffalo so that I can submit to Brazil if I re-apply and I am afraid that if I withdraw now they might take forever to return my documents. I might give it a little more time I guess and wait.

Look at this: I was expecting Buffalo to either transfer my application to Brazil or return it back to me. I contacted them by e-mail and on the e-mail they said my file was transfered back to Sydney, NS and that any inquiry should be made to the Sydney Intake Office. What is going on?
