hmi,
I am from KSA too, in Riyadh. Renewal of iqama takes only a day to finish, and you can renew it anytime before the expiration date. The general safe rule is: no visa on passport, no resignation from current job. Renewal of iqama for me is not the issue here. The main concern is the timing of the renewal of your contract, if you are having a definite contract, meaning you are renewing and signing a new contract every end of its terms. And the labor law in KSA says, employees should give employers at least a month notice if there is a plan not to renew the contract. Now, if timing will be bad, i.e, you receive your visa after you have renewed your contract, you still can resign from your job, provided you would still give your employer a one month notice. But in this case, you might not get your indemnity(service award) full if your stay in that company is less than 10 years. You will receive two-thirds of your indemnity if you have worked in your employer for 5 years. One-third if three years, and you will receive nothing if your stay in the company is less than 2 years. This rule applies to those who will resign from their job before the end of their contract. A different rule applies to those who decides to leave the company after finishing their contract. That is, 2.5 months indemnity for the first 5 years and a month salary for every year thereafter. If you have stayed in that company for more than 10 years, you can resign anytime, you have nothing to loose, provided you should inform your employer at least a month bofore leaving, for them to find for your replacement.
Not so many people including employers knew about this rule. And many employers are not following this, or shall I say do not like to follow this.
A friend from Al Khobar, got his PPR 45 days after his meds. And received his stamped passport 3 weeks after that.He is under the new rules. My suggestion, do not resign not until you have the PR visa in your passport. Try to sit down with your employer and discuss with him possible scenarios, if in case you will resign after the renewal of your contract just in case you receive your visa after you have renewed your contract with your employer. From that conversation, I guess you can get a brighter picture for your planning.
Dear aspire
Thank you very much for giving the brief summary of labor law in KSA. I really appreciate your suggestion and comments, sure it will help me as well other staying in KSA and facing the same problems. My situation is different, let me explain to you clearly,
My company ended the contract with their client few month before and issued us the end of contract letter. It is termination from the Job. We got two choices
1. To go on final exit
2. To join any other employer and get release from them
Now if I will go on exit before the decision and stamping visa from here. i need to notify the CHC and request for other CHC office in my country (because from my country I may not be able to send my passport to London CHC)
So I wish to stay till my Iqama is vialed and do any temporary job by the time may i will get visa stamping
If I will transfer my sponsorship to new employer and get release from my previous employer it will cost me a huge amount (they may not pay my benefit or partially take, and demand a big amount for release letter) and then I have to pay a huge amount to change to sponsorship, because 3rd time change of sponsorship) And after all It will be very difficult for me to resign and land withing few month.
My worries are renewal of Iqama because when I will ask for renewal they may refuse or stamp exit. because still i did not transfer to other employer and nor for exit.
This is the main reason I am gating worried if any delay will occur. Time being I am trying to deal with my company to renew our Iqamas and within few month I will go on final exit hope fully they may agree for that. For this service they may ask big amount.
I will appreciate any suggestion or comments
Thanks again
