I had filed my application under the NOC 1122 category. The application reached CIC-FSW office in Sydney, NS on the July 9th, 2011. However, yesterday i.e. November 8th, 2011, I got a response from CIC office stating that they could not accept my application as the cap had already reached and they received the application after the cap closed. I was told by my process consultant that the cap would be open till August 25th, 2011.

Now, they have sent back the entire documents along with the visa DD and IELTS score sheet. And, when spoken to the consultant, they said that CIC has not informed them about the early closure of the cap. Would anyone throw more light on this? Appreciate all your help and response.

Hi knvt,

I am afraid, but if CIC has received your application after the Cap has already been reached, then nobody can do anything. You have to wait for next year to see if your NOC is still in the in-demand occupation, and then apply.

The other option is applying with AEO, as Cap is not applicable to AEO cases.
