Author Topic: Rejected FBI Fingerprint Application  (Read 895 times)

Hello,

Our initial application for permanent residence went in to CIO in April 2010. We received approval from CIO in July and our deadline to send in all supporting documents to the Visa Office is mid Nov 2010. This means that we need to send in docs first week of Nov. We have all our documents ready to go but unfortunately, my spouse's fingerprint card was rejected by the FBI due to 'low quality of characteristics'. My (principal applicant's) fingerprint card has been approved.

We have sent spouse's fingerprint application back for processing again this week. When we contacted FBI, they said that resubmission might be quicker but it might take up to 12 weeks to get a reply due to high volume of applications. If we do not receive a reply from FBI by first week of Nov, do we send in our supporting documents without spouse's FBI report to Visa Office? Can the Visa Office reject our application due to missing information? Has anyone had this issue before? Any insights, comments and suggestions would help!

Hi indi_go, i would suggest you to send your documents within time limit CHC has  given you. You can always write an explanation letter exactly what you wrote here. When you get the FBI cert than you can send that straightaway.

this is normal case, happens with most of people. You should send your doc asap, & mention that you have applied for FBI report.

By Nov forst week if you get the FBI report nothing like it. If not write a cover letter to CHC explaining the situation and attaching all proof and give a tentative date line by when you will submit wife's FBI report

This is not a unusal case and I am sure CHC will consider

I resubmitted the FBI fingerprint application. As I did not get a response from FBI before 120 days, I submitted the application package to the Visa Office. I got the FBI report recently.

Do I submit the FBI report to the Visa Office at the same mailing address where I sent the application package along with a cover letter explaining the situation? I did not find instructions on how to send additional correspondence to the Visa Office. Is there anything different I need to do?

Sent the FBI clearance letter once you get the second AOR from your visa office.

Yes Submit it to same address.
Write a cover letter with your file number and explain that you have received it late from FBI etc.. If you get second AOR before you send the FBI report, you will get the Bar code stickers along with it. Stick the Bar code on cover letter as well

indi_go,

In my opinion, it is better to wait and see if your file is transferred to another visa office. Sometimes, Buffalo office transfers the file to another visa office and you may not know about until much later. In such cases, even if you send the FBI fingerprints to Buffalo, they will send it back to you / your consultant if you have any as they might have transferred your entire file. The same thing happened to me.

It may be better to send them an email quoting your original file # issued by CIO and ask them where to send the original FBI fingerprint results.
