I sent the 2nd letter last Thursday....so it's been 5 working days already.  Reason why I asked was because they replied to my first letter after 2 days.  

My rejection letter was dated May 15 and I received it after 1 or 2 weeks (i cannot remember).  I know we have at least 30 to 60 days to re-appeal and file a court case.  So when does the 60-day period start? From the date of the letter or from the date you received the letter?  How would CHC determine the exact date the applicant received the letter?  

CHC has nothing to do with determining the receipt date, its the Federal court which has to decide... the limit to file a court case is 60 days after you RECEIVE the letter.....

Did you send the 2nd letter through a lawyer or at your own??

I strongly recommend to use a renowned Canadian lawyer to file the 2nd reconsideration letter otherwise chances of success are less.....

Hmmm.. so, I should wait at least 2 weeks before sending them a reminder?  I'm just worried cuz my 60th day (calendar days) is tomorrow, July 13.

60 days limit starts after you receive the refusal letter....

That is why i suggest to send the reconsideration letter through a lawyer because even if they do not respond within 60 days, the lawyer will file a court case for you, also the lawyer can request the court to extend the 60 days limit since the issue has not been closed.....

Remember 60 days limit is to CLOSE the issue, if the issue is not closed within this limit the court can grant time extension based on lawyer request to do so..........

Again please hire a renowned Canadian lawyer (not a consultant) to file your reconsideration appeals to CHC...... it will be of much benefit.........

Tim Leahy sent a reconsideration letter to CHC but after 2 weeks, a response was received in my case and they refused to re-open my case.
May I request that you and other members share your reasons for the CHC deciding not to re-open the case.
How did they justify the JD mismatch?

Hey Khan ... I just want to clear some points here .... My case was refused cause VO didn't grant us 5markes for relative residing in Canada ; we ended up scoring 65/100 ... I was furestrated but with the info & past experience with members of the fourm espacially Pa55ion, Qorax, Zee81 ... and others , we thought about sending a reconsidration request.... & it goes like this

Well I do not know how many filed the reconsideration through Tim, as per my information most people on the list have sent the first reconsideration request at their own (including myself), very few contacted Tim..... however after getting a refusal once again from CHC, people are opting for Tim.... I will add the ones which I am aware......

CHC's reasons to refuse the reconsideration requests varies from case to case... as my request was not accepted since i did not sent the relevant documents (Salary slips, Contract letters etc) in support of my job experience letters once i submitted the full documents to CHC London and only attached all these with the reconsideration letter giving them a point to refuse ......... They generate reasons to refuse case by case........

I received a letter dated 28 March 2012 from CHC London,In which they asked me to send a letter from my employer in canada.In that letter they mentioned it clearly that i have 90 days to send this letter and i can send this letter via fax.I sent the letter on 23 june via fax and i have receipt of that fax.On 27 june 2012 i got the refusal letter.The date on that letter was 21 june 2012.In that letter VO stated that i could not provide him the requested letter.I sent him letter within 90 days but VO surprisingly took a decision in a hurry before 90 days.Now i have sent a reconsideration appeal through my consultant.

Yes they are in a hurry to finish the backlog cases as quickly as possible...... I wonder why you took 03 months to send the letter from Canadian employer...... you could have sent much earlier??

A Forum member 'Zaidkhan' whose case was refused, got Medicals & RPRF today after getting his case re-opened.....

Good news, so CHC is acting quickly after the closure of new FSW applications.......

May be those which get their cases re-opened, will be issued Medicals earlier since their cases have recently been reviewed by the VO and they do not want further piling of cases.... so they issue the Medicals immediately to avoid another backlog to develop..... 

All my personal thoughts though.........
