yes i did reconsideration and got approval on .....

I would like to know whether only Pakistanis, Arabs, Indians and other Muslim nations are being rejected or even English, Germans and other nations are being rejected too... cause I think they are choosing who to reject and who to accept beside they dont earn enough points.

Well made thought dear....... this discrimination has been done with Muslims only and that to mostly with Pakistanis as these are a big chunk of their backlog............ so they are doing pick & choose ......

LVO given me 65 points and refused my case on 15th May.. I did receive a letter on 4th June.. According to letter VO was not satisfied with my blood relation..

I was surprised to see that VO also did not given me spouse education points(I sent spouse BA attested university sealed transcript after 2 months of full docs but before issuance of 2nd AOR) VO also not returned that transcript with originals..

I wrote a reconsideration letter on 9th June with more proofs of blood relation and also mentioned that I had sent 13.5 yrs education certificates with full docs and 14 years transcript after 2 months (also attached courier and receiver receipts).. I wrote that VO mistakenly ignored my spouse transcript as he/she also not returned it to me. Kindly give me 4 points for spouuse and 5 points for blood relation. I need only 2 points and I deserve 9 points....
I sent this letter with attachments through courier as well as through email.

They replied me on 28th June that at the time of assessment your relationship was not satisfactory so VO did not give you blood relation points and/or VO was not satisfied with your's spouse post secondary education (you have failed to provide bachelor degree).

Your file will not re open.... And in last note: no request will entertain in future in this regard...

I was shauked to see this...

I again wrote an email on 30th June and wrote that
1. where is my spouse transcript. I believe that VO misplaced it because I sent it quite in time before 1 year making decision. Please find it ... Consider it and return me because this is original document and I can not bear the loss of it.

2. Why VO not given me minimum 3 points if 14 years transcript misplaced as I already submitted 13.5 years education certificates with full documents..

I need only 2 points please give me spouse education points...

Now I am waiting for their reply...

This is my whole story... I also wrote a letter to TIM 2 days before but he did not reply me as I think my appeal time is very short.. DM letter was issued on 15 May...

What you suggest about my case... You know any other lawyer?

Actually Tim might have been busy with the Federal Court Judge yesterday regarding the Pre-2008 applicants case..... as i have just received an email from him in this regard.....

My name, address and contact details written on refusal letter was correct.
But the reference they used under the heading of 'Our File' : B0XXXXXXXX was neither my old file number nor my new file number.

What do you think? People those got there refusal letter has difference "file number' written on the letter as mine. Or they have their own file number written on the refusal letter??

I think you should immediately send an email attaching the letter with wrong file number. May be they have sent you letter in error. You must check with them.

I already responded to your post in details yesterday and sent you an email for proceeding further.......

Again i am quoting that if the original documents belong to you then it is confirmed that the refusal letter is for you.... and by mistake wrong file number was written on your letter...... You can further get clarification from CHC by sending an email, Case Specific Inquiry or check your E-Case status if it shows 'Decision Made' then you are rejected...... 

You should get CAIPS notes for the detailed description of the reasons on which you were rejected.... yes the refusal letter will tell you that its JDs mismatch but remember this is a TYPICAL format, you need CAIPS for actual and precise reasons......

Also hire some consultant or draft a reconsideration letter as soon as possible.....
