Dear Brothers, please clarify one question that i have. at the time of getting refusal letter for JD's Mismatch, what was your e-cas status? RBVO to DM or In-process with date to DM? i am in-process with date and i am a bit worried, please clarify.

Mostly Our status  was 'In Process' WITHOUT date..........

If your status is In Process with date and you have not received a refusal than at least you are safe being rejected due to JDs mismatch issue...... So Don't worry friend you are SAFE.....

Guys and Girls please listen me carefully, you are not Canadian citizens so don't waste time and money to go to the courts, just write a good consideration letter and look for other options for your future it was meant to be and the lawyers will just earn money from you that's it

Even though its been paused these days the applying for FSW... I dont care about that, I wanna apply and send them my documents..
I dont earn enough points (for 67, I get 61), I have experience as a Marketing Manager, Sales Manager and Paints supervisor.. I also have successfully completed certificates for Painter and decorator....

Thats what I was gonna write to them in order to be well economic established in Canada... but didnt know how to write it...

I respect your thoughts but in this case we are having mass refusals due to JDs mismatch and all to reduce CIC's backlog........ this is unjust policy which they are adopting and we have to resist it, we should fight for justice........... Lawyers will have their charges and only those can hire them which can afford to do so.....

And remember one thing no matter what you write, CHC will NOT re-open your case if closed due to JDs mismatch issue..... I wrote a very comprehensive reconsideration letter explaining each and every performed duty in terms of NOC, even attached email inquires from reputed Canadian employers which wanted to hire me as soon as i get the landed immigrant status, but nobody bothered to even look at it seriously..... after a week i received an email that they cannot re-open my case........... I can assure you that if somebody (Program Manager) would have read my letter seriously he could not have found any reason or logic not to reconsider my case!!!!!

So dear its up to individuals that how much desperate they are to move to Canada and how much guts they have to Fight against injustice?? I am sure Canadian Courts are not biased towards their citizens, they provide justice to anyone which consult them.......

I am just wondering if they have released their latest data on no.of applications and no.of refusals.

Like I said in my previous post , a court can only ask the CIC to look into the file. The CIC , can again turn around and say, ' looked, still not eligible !!'  The court cannot order CIC to grant someone a PR in FSW.

I am not justifying what they did, i am just saying, going to court/lawyer for JD mismatch, is a waste of money unless and untill the immigration act is ammended, with a tribunal to hear/accept appeal on rejected cases.

The comments, of the VO are very highly upheld. You can go to court on the proceedure/process but not the decision, view of the officer!
anyways, my honest request to people is dont waste money on lawyers/consultants. move forward, look at other countries !

Mass refusals not with respect to this forum only but if you go through various forums (specifically Pakistani forums) you will come to know that about 50% of MI-1 Pre-june 2010 cases have been rejected based on JDs mismatch issue........... and do remember that its the Visa Officer's obligation to carry a FAIR assessment of all applications and if he is not satisfied, he HAS TO PROVIDE undeniable / logical and strong reasons for refusal...... isn't it?? and if the reasons are not strong and logical, can these not be challenged in court??? Is it a FAIR assessment which they are doing to reduce backlog and close the files as soon as possible effortlessly??? 

I have seen one person which got the refusal since his experience letter did not contain a date of issue at the top, it was at the end of last paragraph..... is this a Valid reason for refusal??? Look at my case 05 experience letters provided...... regarding 04 letters the VO is saying that sufficient JDs are not performed and for 01 he is saying that the JDs are too much inspired from NOC? what we should do to convince them??? not one way or the other they are accepting to process the cases........

Yes the court can only order CHC to reconsider or review the case based on its decision and give a FAIR assessment....... and one needs a strong case to let the court give an order in his favour...... so if you consider your case to be Genuine and strong enough, feel that a fair assessment has not been done by the Visa Officer what is the harm in going to court??? and of-course you have to spend money.............

Its quite confusing...... why they want to say that your application is still with the Visa Officer once ur CAIPS clarifies that its a rejection
