Hi,

Those Pre-June 2010 cases which are Refused due to 'Job Duties Mismatch' please connect here.... We all need to File an appeal in Canadian Court to sue CIC for this unfair behaviour.... The charges will be as low as more applicants are gathered.... You need to have strong and relevant Experience letters matching with Jds of your NOC....

there is no such thing exist in canadian laws, its just that if u give bulk cases
to the lawyer, he may reduce his/her fee a little but how he/she would spend
quality time on all the cases.
its a  million dollar question, thx.

for ur kind info they jst represent the case in the court, an assistant of them prepares the case.

I do not agree that there is no law in Canada to appeal against such rejected cases due to baseless reasons.... Tim Leahy is a crediable Canadian Lawyer and his efforts partially forced CIC to at least review the MI-1 cases....

Everyone has his own ideas but i strongly believe that if all refused pre-June 10 cases due to baseless reason of JDs mismatch can file a case collectively it can be successful as such a reason to reject bulk of cases had never happened earlier I suppose....

Look at my case I am Civil Engineer with 10 years experience and rejected due to Jds mismatch.... NOC 0711 is for Civil engineers / Construction Managers Who else...... Can anyone answer?Huh  Cry Cry Cry

This is totally unfair on behalf of CIC and a way to reduce the backlog nothing else......

u misinterpreted me,


1.  If you go for judicial review collectively, who would assure that cases wud be taken seriously.
2.  generally, Judges dont interfere in such decisions based on Job Duties because Canadian law suggests
that the VO is expert in this field, hence, judges give very high deference to his decision.

here, Im not sayin that JD cases cant be challenged, u can challenge that but u sud have solid proof
to show that ur JDs are very similar as laid out by hrsdc.

JR ek achi option hein, agar aap fight karna chahte hein toh.
point ye thaa, kee joh lawyer bulk cases lega, is baat kee kya gurantee kee woh inko ache se handle karega,
recently, ek lawyer ne, 9 cases lodge kiye, ek hee ground this sabki, court ne sabhi ko dismiss kar diya.

meri baat kee bareeki ko samaghiye.
