Received a replacement WP after my CEC application was made, comp name was wrong

Hello Everyone,

Need your advise here , I have just received a replacement WP that overrides the earlier WP document which I had(The reason the employer name was listed incorrectly).

I am in a fix now, do I need to notify the CIC of the new WP received and a possible change in the company name that was made in the "Schedule 8 - Economic Class - Canadian Experience Class",as the earlier WP document was what that was submitted, along with the Old Schedule 8 form i.e 2011 Version(with the company name in it as that of the old WP) for the CEC application at the office here in India.

The application was made off late with the received date as on 28th Dec 2011, I have received a letter notifying to wait for about 90 days to receive an AOR from the CIC Buffalo.

Following are my questions:

1)Do I need to send both the Schedule 8 and the new WP to the CIC offices both in India and Buffalo or will only the WP do?
2)On submitting is it possible they might reject the Schedule 8 as the earlier application was made in the old format as of Dec 28th 2012, and there are changes effective  Jan 01 2012. (Also a note here the company name change has been something like ABC Canada and A(expanded) B(expanded) C(expanded) Canada Inc, all this while the name ABC Canada has been constant on my earlier Canada WPs)

I am in a total state of fix and confusion out here , kindly advise

I am a little confused.

Once you hear from buffalo submit a case specific inquiry explaining the correction made to your work permit. You may or may not do that as you are applying under CEC. That's my best guess.

I am sorry but I am confused if you are applying from within Canada why is your application in India??

Coming to your question, Well I have relocated to India after my stint of over 2 Years in Canada. Hence the reason for applying from India.The reason  I mentioned both the New Delhi and Buffalo office was because I wasn't sure if my application was still at India CIC(my office of submitting) or had it moved over to the Buffalo CIC. Hence I thought of sending the case specific inquiry it to both the places.

Coming to your adivse: "I may or may not do that as it comes under the CEC category", I wasnt clear with that, do you suggest it wont be an issue even if I did or did not notify them of the changes? - Both with a New work Permit copy and a revised Schedule 8 Form with the corrections made?

Please let me know, I am not too sure what the CIC expects of applicantsr and how it wud responds to my case.


Also  AINP App I have have realized the following differences in the old and the replacement WP i received:
1) One Is the employer change as I had described in the earlier thread.
2) The other is the NOC category that has changed to 2174 from 2173 i.e the Occupation is titled now as ITERACT MEDIA PROG & DEVELOPER(2174). The earlier one was EMBEDDED SYSTEM SOFTWARE DESIGNER(2173).

Apparently my NOC have fluctuated from 2173 and 2174 over the 2 Years I have been in Canada and in all my WP extensions that I have received, I guess the reason being that I am a Software consultant and the descriptions generically fit under these categories.

Hence another dimension added to the Schedule 8 Form in terms of changes, and to my confusion  , So do you suggest I submit both the New WP and the Schedule 8 form as well and a letter stating the reason for the changes?

Ok, so from what I understand.

1) Since you had applied in India, your file is in India and not in Buffalo. Unless, you have received a confirmation notice or a file transfer notice from Indian consulate.

2) Since you had applied to the Visa Office under CEC they evaluate your application based on the experience you had gained in Canada not the experience you will gain in Canada. With that being said, you may notify them of the changes but do not need to submit a new form. As they process applications taking into consideration the rules and forms that were applicable at the time the application was submitted.

3) You may submit the new work permit and advise them of your current status in Canada - its entirely up to you.

Let me know if I wasn't too clear and if you would like to talk a little more.



I would also wait for a few seniors to reply as I am a provincial nominee and have little experience with CEC rules.

Hi AINP App,

Thanks a ton once again. I think I have understood what you have said I have summarized it in BLUE below:

On the other hand , Just to update you my status vis-a-vis my Application/WP/Stay of country:

1) As you have mentioned I have received a file transfer notice from India CIC Consulate, stating that its been sent to Buffalo for further processing and to wait for about 90 days within which a response will be expected from Buffalo.( I expect a response in about a couple of weeks time, based on trends of CEC cases sent from India).

2) You have rightly mentioned I have filed for my CEC on the experience I had gained in Canada over the last 3 Years (with 2 years + received) and returned back to India due to the fact that my services(I am on an Intra company transfer) were no longer required.

3)Apparently my WP is technically still valid till about Oct 2013 and hence a replacement copy(with the changes to the employer name) were sent across by the CIC to me.

4) Till the very last day that I was in Canada, the above WP (expiring as on Oct 2013) was my legal copy(permit) for working in Canada and since there was a replacement(WP) to it much later , I was in state of confusion as to whether I should notify the CIC of the replacement copy as it overrides the earlier one.


To summarize what you have suggested is that I could possibly notify the CIC of the changes in the replacement WP i.e the Employer Name and the Occupation changes vis-a-vis the earlier one WP.I will not submit the Schedule 8 form as advised by you, but rather mention(this is what I feel I should be doing) of the fact that the Schedule 8 form submitted with the application was filled in keeping in mind the earlier WP details received i.e the Company and Occupation. So that I dont give the CIC officer a chance to question stuff  .

I also believe the occupation should not be a big deal, due to the fact that 2173 and 2174 have certain generic roles/responsibilities common to both of them.


PS:  (I just hope the VO doesnt get too confused with the replacement WP copy I send, at times I think leave things as is .... as he/she would figure out a new WP was issued thru his Database, but again I also hope he doesnt end up rejecting my application on knowing for a fact that the latest copy of the WP issued was not sent to him )  -Drives me crazy at times(totally complicates things for me!! Why me after all !! )---

I dont know have this Hunch that this New WP was sent only after having receipt/going thru of my Application at the CIC Delhi, cause the sequence of dates are like this :

CIC Letter dated 9th Jan ,2012  stating the receipt of application at CIC Delhi/ Processing Fee receipt $550 dated 9th Jan ,2012.
Application received date(which will be considered for qualifying for CEC) as mentioned on the CIC Delhi letter : 28th Dec 2011.

Replacement WP has a dateStamp of 12 th Jan 2012.

Yup you got it.

Since you were an intra company transfer I suggest reading a few posts here and prepare to send additional documents when asked for. Or if I was you, I would just send them now. Again these are personal comments and not the rule of thumb.

I think I will wait for the AOR and on receipt of it, if will notfiy the CIC Office either Buffalo/Ottawa and will send in the other documents at that point in time.

I did manage to see a few posts as you had advised for the Intra company trasnfer cases, requirement of "No Obligation Letter from Employer"
CIC is quite unpredictable and well the Journey seems to be full of surprises.

Ottawa could be a bane as well as a boon, seems to be specific to this CIC office:

Its a co incidence infact I was contemplating on shifting my company(yet to decide, cause I have another query realted to this) and hence a releving letter or employment letter for service rendered would defnitly suggest that I no longer have any obligations whatsoever with my X company and that Letter should defnitly serve the purpose in terms of "No obligations" is what I believe.

The other query was if I were to quit my current company, I believe I would still qualify for the CEC category with the no of years of experience, though my current company WP does gets invalidated now(as i would not serve the company anymore).

I dont think there is any requirement mentioning under the CEC class that mentions of the fact that person needs to be employed on WP permit till the receipt of the PR.Cause it states you do not have to be emplyed at the time of applying for the WP, plese correct me if I am wrong here.

Anyways one can hope for the best, no on, thanks once again.

As a CEC applicant you can quit your job, but collect all the reference letters before you do that. You just need the 2 year work ex to qualify to apply - once you apply to CEC you are free to return to home country, quit your job etc
