question about wife coming to canada while outland process is pending

hello folks ,

I would like to get few answers about sponsoring my wife.

-what will happen if i apply for her sponsorship and while the application is pending she joins me in canada as a student is it going to delay the process or make any difference in the process.

- I received my PR through Alberta provincial nominee program. is there any different set of rules in order to sponsor my or is it same for every canadian PR holder?

- Is the outland sponsorship process quicker than the inland sponsorship process? ( my wife is planning to come canada as a student spring semester 2012 so i am trying to check if i should file application or wait until she comes to canada)

-I am moving to canada at the end of this month and hence would be looking for job will this affect any way in my sponsorship application?

1) No, her being a student in Canada will not affect the process.

2) The rules are the same for all PRs, regardless of how they became one, provincially or federally.

3) That depends on what office will process your wife's application.

One more question just out of curiousity. lets say I apply for sponsorship for my wife through outland process and 3-4 months down the line she comes to canada as a student. now i guess the remaining procedure should go thru inland process? and should apply thru visa office inside canada? i hope its not dumb questions. i am just trying to answer as much questions answers to infomr my family. Let me know any informations. thank you very much.

No, the application can be either Outland, or Inland, but not partly one and partly the other.  When her file is transferred to the visa office overseas, just because she comes to Canada does not mean they will send it to the office that deals with In Canada applications. 

Outland or Inland refers to where the application is processed, not the location of the applicant.  An Outland applicant can be anywhere, while their application is being processed by the visa office responsible for persons of her nationality.  An Inland applicant can only be in Canada.

So my understanding is My wife is from India but she is studying as an international student in USA. now when she enters canada as as a studnent. her application will still be processed by buffalo visa office once /if the application has already started. doesnt matter even if she is residing in canada Buffalo visa office will continue processing her application.

If you want Buffalo to be the processing office, make sure she will be able to enter the USA for an interview. If there is some chance she won't be able to enter the USA, select her home country (i.e., New Delhi) for processing. If she won't have a valid US visa at the likely time of an interview, the US gov't probably won't issue her a new one just for the interview; so it would be safer to select New Delhi as the visa office - and New Delhi is faster than Buffalo anyway.

Thanks a lot canadianwomen. thats a great point. yes my wife still has a usa student visa valid for another 2 years.
