Hi everyone:
My brother in law wants to apply. He did almost all duties of a restaurant manager but his bachelor degree is not related to this occupation he has a degree on business administration with master on business management. Could he apply?
Thanks

The critical point is that your brother-in-law performed all the main actions and the majority of the job duties of NOC 0631 for a minimum of one full year.  If he has proof of that it does not matter that his education was in another field for the purposes of FSW1.  That NOC is expected to reach 1000 before July, so it would be a good idea to get his documents together and sent off as soon as he can.  Good Luck.

Agreed 100% with pippin. Experience is the key for CIC. I second pippin that let him file his app ASAP.

Cheers

Education is listed as one of criteria for a NOc code but most of it depends on Job duties. As others said if your Brother in law can prove that he did the job duties of a restaurant manager he can apply

I am sure it says somewhere that the VO is not allowed to consider field of education in FSW selection.

Here it's pippin,

Op06:

Officers must:

 consider only those occupations which the applicant has specified and for which the applicant has provided the four-digit NOC code on their application form (R80(6));

Note: While the Regulations clearly place responsibility on applicants to undertake research of the NOC and provide the NOC coding for the occupations in which they claim qualifying experience, officers are expected to exercise discretion where applicants may have made minor errors or omissions in correlating work experience and NOC coding.

not take into account whether the applicant meets the ―Employment requirements‖ description set forth in the NOC for the occupation(s) listed (R80(3));

 award points only if the applicant has performed the actions described in the lead statement of the particular NOC description and has performed at least a substantial number of the duties described in the ―Main Duties‖ summary – including all the essential duties (R80(3));
