    So sorry to hear about the rejection by BIQ. I will advise you to do indepth research and then appeal. Show them evidence you should really get 6 for employment. I wish you all the best.

Ok, sad news, today i've recieved intention of rejection (perm401) due to insufficient points :-(
So, what i have:
Education: 10 (expected 10)
AOT: 0 (expected at least 6)
Experience: 4 (expected 6)
Age: 16 (expected 16)
French: 2 (expected 2, now have A2 so will get at least 3)
English: 6 (expected 6)
that makes total of 38 out of 42 of preliminary (employability) stage required which sucks, anyway need some advice what to do next with few things:

1st - AOT - how to convince them to compare it against certain quebec degree - i thought about printing list of all classes on similar major on quebec university - what do you think?
2nd - French knowledge - I've passed A2, have results online, but wont get paper diploma within next probably 2 months, which sucks, cause my CSQ file will be rejected in 60 days - can I send them details of AF center i took the exam along with my candidate number to verify it?
3rd - A2 - i got 18 on listening and 5.5 on speakin, according new rules its 3+0, how was A2 counted before dec 2011? Can anyone advice, I can ask then to review my A2 against old rules, which was valid at the time my application was submitted

You have given us some happy/sad news...first of all congrats on passing DELF A2.  Conversely, I am sorry to hear or the response from BIQ.  I posted the following information before, I think it will be helpful to you at this time:

God Forbid ,If you get a letter in the mail from Canada Immigration advising you that your application for Canadian immigration was refused, do not panic! You have options.

    You may be eligible to Appeal your Canadian Immigration Application Refusal to the Federal Court of Canada within a certain period after you were notified of the refusal by Canada         Immigration.
    You may be eligible to Appeal your Canadian Immigration Application Refusal to the Immigration Adjudication Division (IAD) within a certain period of after your application was refused by Canada Immigration.
    You may be able to make a request for Restoration to the Case Processing Centre (CPC) after being notified if the refusal.

Which option is right for you:

It depends on a number of factors such as the nature of the case. Is it a Skilled Worker Application, Canadian Sponsorship Application or Canadian Work Visa refusal?

And it also depends on where the Canadian immigration application was filed and processed. Was your Canadian immigration application filed within Canada or at a Canadian Consulate or Embassy outside of Canada?
Why did my Canadian Immigration Application get Refused?

Generally refusals for Canadian immigration applications do not just happen. When applications for Canadian immigration are submitted to Canada immigration, an immigration officer is responsible for reviewing the application and making an assessment about whether the application should be approved or denied. The immigration officer has guidelines for making decisions on immigration cases. These guidelines are found in the Immigration Regulations as well as Immigration Manuals.

When applications do not meet the various standards and criteria set out in the Immigration Regulations and Manuals, then the likely result is a refusal. However, in many cases, Canadian immigration officers make mistakes in their decisions. They often are too strict in their interpretation of the guidelines or they simply fail to review all the documentation and information in an application. Sometimes applicants are called for a personal interview and the immigration officer does not believe the applicant is credible or trustworthy.

Whatever the reason for the refusal, it is important to act very quickly once you are notified that your case was denied. You should then seek out a qualified and experienced Canadian immigration lawyer who is licensed. If your case has merit, then an Immigration Appeal should be considere

Canadian Immigration Application Refusal

It can be devastating to learn that your application to reside in Canada has been refused.

APPEAL OPTIONS (CANADIAN IMMIGRATION)

The formal place that immigration appeals are made is the Federal Court of Canada. Most people choose to be represented by a lawyer at Federal Court.

The Federal Court is a court that has judges who are lawyers. Federal Court is strict, formal and has more complicated procedures. Federal Court involves a two step process. The first step is to file an appeal to get leave which is done by arguing your case by filing documents with no actual appearance at the Federal Court. In order to get leave to appeal you must prove there was a serious mistake made by the visa officer at the interview. If you succeed and get leave, you get the permission of the Federal court to go to step two which is the actual appearance at Federal Court in person to argue the case.

A typical case would be a skilled worker or business (investor, entrepreneur, self-employed) immigration applicant who goes to the interview at the Canadian Consulate or Embassy overseas, meets with a visa officer and fails the interview. The visa officer will issue a rejection letter setting out the reasons for the rejection. The applicant has a limited number of days (60) to respond and file a notice to commence a court action to appeal the case. If you miss the deadline generally you are not able to file an appeal. There are certain special circumstances and legal arguments that can be made that will allow you to continue even if you miss the deadline.

The general procedure for a Federal Court appeal is after the applicant files the Notice to start the action, the Respondent who is Citizenship and Immigration Canada (“CIC”) files an appearance confirming they will oppose the appeal. The applicant receives a copy of the visa officer's files containing documents filed and most importantly a copy of the interview notes made by the visa officer that have been inputted into the government computer. After a review of this material the applicant will file an applicant's court record containing the written argument, photocopies of legal cases and law supporting the argument and the applicant's affidavit that is a written document telling the applicant's story.

The respondent CIC is represented by the Department of Justice (“DOJ”) and they file their argument. The applicant has a chance to respond to the points made by the respondent in the respondent's argument.

If leave is granted the Applicant gets to go to Federal Court to actually argue the case in person. This usually takes approximately 12-18 months from the date of commencing to appeal to get to Federal Court to argue the case in person. If no leave is granted the appeal is ended.

If you fail at Federal Court, you can also appeal to Federal Court of Appeal. If you fail at Federal Court of Appeal, you can also appeal to the Supreme Court of Canada. For both Federal Court of Appeal and Supreme Court of Canada you first must get leave to appeal.

This is really a very sad news about your rejection, yes u go for appeal and everybody here will try to help u, regarding your aot points could u please tell us what is your qualification, when u finished your degree, and what is your job at the moment so we try to relate with your qualification.

Regarding point for your French then u can send provisional result with your application appeal.
Regarding your experience send two-three evidence for your job like offer letter , pay slip, promotion letter or any recent letter from your employer that you r working from this company from this time to this time.

Hope u will be allright with appeal.

So my advice to you is to start to build your case.

1) you may contact an immigration lawyer and state your case, I am not sure how they will treat with your case if you were not represented by them in the first instance.

2) you recently passed the DELF exam, the only two results Quebec is interested in is listening and speaking...you passed the listening but the speaking will be a factor.  listening and speaking points are counted separately - submit your results at once.  Opposite to what you stated I am not sure you can retake the DELF once you passed (pass mark is 50) you may have to go to the higher level B1 or A1 so you can pass the speaking and get points for that.  Also, you should be assessed on the criteria the time your application was submitted not under the new rules.  I think before once you stated your knowledge of French/or English....with a little proof you woul dhave been given the points.  Now they are asking persons to verify it with authorized test

4) Experience
Work experience must have been accumulated during the five years preceding the application date.
Work experience includes remunerated employment and internships, whether remunerated or not.

To gain optimal points for experience your AOT must or should be related to your experience

. In your long story u r talking about federal part, but he is refused in BIQ side, so this is nothing to do with federal part.[color]



You missed my point ambi,

even though it points the appeal at the federal level it still have some applicabilty to the quebec selection process.  for starters you have to know the basis/nature for the intention to reject and to challenge if neccessary.  Visa officers are people also and may make mistakes.  my response was to give hope that it doesnt end here for stngr, he only has 60 days....my response was to get him to build a case...so it is not about having nothing to do with the federal part but it has everything to do with challenging the decision made using the federal as an example

thanks guys, right now i'm going through my university transcript, tryin to compare it against Quebec program and mark as much classes (as per GPI page 25 - "Overall, two thirds of Courses must be related to specialization.") I can from my diploma in relation to quebec classes:
http://www.ita.qc.ca/fr/lapocatiere/finitiale/TPQA/Pages/TPQA.aspx (tab grille de cours) - its worth trying, cause most core classes match and this AOT is worth 12 points (Technologie des procédés et de la qualité des aliments) - briefly my major was 3.5years (7 semester) undergraduate university, tryin to match it with 3 years college from Quebec (no colleges in my country's education system)
thats my biggest concern for now - get through with AOT as it gives most points.
Note: my graduation for this AOT was in 2008, it's not related with my work experniece (except 2 internships included with application) HOWEVER nowhere in GPI is stated it has to be, only that "the best for applicant will be counted"

As for employment - will have letter from my employer (citibank) i worked for more than a year after i've submitted my CSQ app, so this will be +2 without any doubts - everybody loves corporate experience Wink

The Quebec selection criteria is based on nine factors, these are:

Training
Valid employment offer
experience
age
language proficiency
stay in Quebec
spouse's characteristics
children
self sufficiency

my humble suggestion to you will be to send proof in other areas to gather more points.  For example, for self sufficeincy submit a copy of your bank statement(s) on average over the last year to show sufficient funds and obtain that 1 point.  look at career sites specific to quebec, print a list that your area of training is in demand in Quebec.  For adaptibility (or valid employment offer), demonstrate that you have been applying to these places for work opportunities and indicate it is hard to get the job from the outside but once in Quebec, you will be fine.  The point is you want to get as much points to prove your cas, consider those areas that may have been overlooked with supporting proof

Hi all!

Just to update some important information for people applying from India. I might be appearing for DELF A1 this tuesday and hope to clear it. Now, what i also wanted to do is to appear for TEFaQ examination directly and get rid of the DELF exams as AF Mumbai has a lot of restrictions in appearing for the courses.

So the important news is that after inquiring at all the AF centres across the country, have finally found out that only AF Trivandrum & AF Sri Lanka conduct the TEFaQ examinations. I have been told that TEFaQ is compartively easy and the shortest route to prove your french proficiency to the Quebec immgration agencies. Get in touch with the AF Trivandrum centre for the March or May exam schedules.

Thank you Bajan, but i think those suggestions refers more to interview than preliminary assesment, but I'm also considering to write small letter describing my interest in Quebec
