I am currently not living in Canada, but obviously plan too when my common-law gets his approval.
I am signing a rental agreement, for 1 years time in hope that we will be there. And as one of my evidence showing that I will be going back.
My question is should my common law partner be included in this rental agreement, even though he doesn't live there. Am I assuming to much by inlcuding him??? The agreement says that aside from the tenant listed in the contract noone else can live there.
Should I include him???

Since you expect to be living with him there at some point, yes, go ahead and include him.

You had better include him! You are using this lease agreement as evidence that you will return to Canada when your partner gets the PR visa, so if the lease agreement says only you can live there, it won't be very good proof your relationship is genuine.

Depending on what ties you have to Canada there are many other things that you can use to show that you will be returning with him to Canada, if you don't want to actually do the rental route this early on. If you have bank accounts you could send in statements, if you have family or friends you can ask them to write a letter saying they know you will be coming back, and will support you/have you stay with them until you get settled. You can write a declaration "of your own free will" saying that you will be coming back to Canada when they get their PR, if it's possible to get a job offer, you could include that. A copy of a Notice of Assessment from a previous year to show that you have regularly filed taxes. I also am living outside of Canada. I was able to send in these things, as well as a copy of my residence card (not notarized) showing that I was legally staying with my husband while away from Canada. Without a place of residence I was accepted as a sponsor. Hope this helps.

I am also a non resident of Canada and was advised that I could included job applications and my Uncle has written a letter for us stating that we will be staying with him while we look for an apartment.

Firstly- with regards toy our question about whether or not to include him on the lease, I would (there doesn't seem to be any reason not to).

However - if you are only leasing the place in order to 'prove your intent to re-establish' you don't have to go this route. You can provide other (less expensive) proof. Such as active Canadian bank accounts, a Job offer, letter of acceptance to a Canadian Educational Institute, letter from friends and parents stating you can stay with them and they are aware of your plan to return, a letter from yourself stating your intent to return, proof that you have been searching for a job, canadian assets, tax returns from the previous year showing you still file taxes in Canada ect. People have had some really solid ideas here as it is really difficult to get the proof they want without knowing exactly (or even roughly in some cases) when you will return - there are a few threads here devoted soley to this topic.

everybody here is right!! what i would add:

1. in ur letter explaining ur intent of return to Canada explain also ur current ties with the current country of residence; make them see that there are not that many (no family, friends) and the main thing which holds u there is ur partner - once he can go from there, there is no reason for u to stay; by the way, if u stay in the current country with tourist visas CIC does not consider that u reside outside Canada
2. if u still have Canadian bank accounts, credit cards is very good and it's another proof that u have never intended to leave Canada permanently; also maybe u have membership cards (to gyms, libraries, colleges) those could help too if they r not expired
3. if u visited Canada often (maybe some family or friends) while u were residing outside, tell them - it's not a significant proof but it's still good
4. the most important for them to see is that u will have a the place to stay; if u have family or friends who could help u with that for the first months there and also write support letter saying that they will, then i don't think u need to lease with so much time before (u never know how long this process could take)

overall many people are in ur situation and they have been approved as sponsors maybe even with less proof so don't worry; but be prepared that before they issue the PR visa for ur partner they will ask clear proof that u (the sponsor) will leave the current country
of residence (resigning ur current job, canceling ur current residence visa or other depending on the region)...but until then, there's still long way...good luck Smiley
