Sorry, I don't agree with opinion of other members. My wife got visit visa recently and our PR application is in process, I also clearly mentioned on my student visa app that if granted PR I will stay in Canada. Couple of my class mates got student visa during their PR process. if you read the guide it clearly says PR and Temporary visas are two different categories. they want you to leave Canada after you have completed your studies but same time they are offering Post Study work permit for up to 3 years which can lead to FSW-3 (Canadian Experience Class), so legally living in Canada after your studies is not a big issue. They don't want you to come to Canada as student and don't study and after completing your studies if you don't have a valid visa like work permit, post study work permit or PR then you should leave Canada. So, if your PR application is in process and you want to apply for study permit and you meet all the requirements for study permit apps then no problem. if you contact relevant VO they will say same thing, I got similar reply back in 2010 for my wifes visit visa.

He said his dad has been issued his PPR, which means their passports must have been submitted. I am yet to see any VO that issues Study Visa without passport. If he had his passport with him then it would be a different thing entirely- it is absolutly possible to get Study permit even if you have got PR in process.

You should apply for the student visa and if you meet all the requirements for it, you'll surely get it. in the student visa application form, there is a place to indicate whether or not you have applied for PR/Citizenship of Canada. Tick yes.

i dug the forum i found few cases which have been accepted while the others haven't received favorable reply from chc. So i guess it depends on how strong the applicants case is.

now i have few more questions if some one can answer.

our visa office is new delhi. they issue ppr at the same time as medical. so our passports are with them since October still there is no news yet. I dont want to go down the study permit route but suppose if i go with it do i have to ask chc to return my passport or should i just apply without passport as passports are with nd chc already? My medicals are valid till october '11. So i hope i wont have to redo the medicals.

seniors pls help.

this is my opinion, do not take your passport back, wait for the visa you might be lucky to get it before resumption of classes. transfer your admission for the following semester if it is possible.

I hear that Visas would be issued by July (i have no source to back it up, just saw it some where on the forum). Be patient!

thank you guys. i'll wait till july. in mean time i'll inquire with university if its possible to transfer my admit.

Dear mrunal,

An application filed for PR doesn't prohibit you from applying for study permit. Only point is that, you have to satisfy the conditions stipulated by CIC for applying for a Study Permit.  If you have already got offer of admission from one of the Colleges/ Universities, you have a strong case in your favor.  Intention to become a PR is not illegal, and that is why your father's application was accepted. In the meantime, if you got admission in an institute, and you are ready to pay the fee differentials and submit required docs, there are no problems at all. Please go through the cic website: cic.gc.ca/english/study/study.asp and the clause “Dual Intent” explains a similar situation.

It says: An intention by a foreign national to become a permanent resident does not preclude them from becoming a temporary resident if the officer is satisfied that they will leave Canada by the end of the period authorized for their stay.
