Author Topic: PR got Rejected.. how to claim/get refund processing fee  (Read 1547 times)

Hello

Three of our friends applied Canada PR (2 through a consultant) and myself applied directly without any consultant at the same time. All three files are got approved in the initial stage and asked us to processed further with additional documents submit to the Canada Visa Specific Office (LA, USA in my case). After 3 months all three applications was got rejected but for those who applied through a consultant they got refund of 'Processing Fee' but for me they are saying that i am not eligible to get the refund. All three applications are got rejected on the same stage with the same reason but my friends got refund and i am not, I dont know what is the difference and why i am not eligible if my friends are eligible for refund. I emailed couple of times and they are only saying the same reason every time what ever they mentioned in the rejection letter.

I need some help/tips/pointers how to claim the processing fee?

Sorry to hear that but what was the cause of rejection , may be if there was something misunderstood may be you could give an explanation letter and try see what happens?

Even though you all got rejected around the same time, it's likely the consultant took some time in preparing the application, so it may simply be that they were rejected at an earlier stage, before the processing fee was "spent" by CIC processing the application.

I think one of the reasons for rejection is the fact that you had 3 applications at the same time. This shows desperation and there there will be discrepancy of information.

consultants charge a fee when they are hired, most of the time they use the refund as a marketing tool...saying they will refund fees if the application is unsuccessful.

maybe what your friends were able to refund was the consultant's fee and not the actual CIC processing fee? it is possible right?

because, IMHO, you cannot refund CIC processing fees once the application process has already started and it was rejected or withdrawn.

Rejection reason what they said is same for all three guys...

"Responsibilities are not listed on experience letter" ..Infact no Indian IT company will write list of responsibilities in the experience letter (i hope).... wrost case instead of asking the explanation/more documents or more information CIC is directly rejected the file...

My friends got the CIC processing fee only not the consultant fee becauase check they got it directly from CIC not from the consultant.

Is there any way we can call or contact to get the refund?

Having your applications been refused around the same time does not mean that you all were in the same stage even if the reasons of rejection are the same.

It is a little complicated matter, many people were wondering what does the update on e-case "Visa office eligibility review complete" means, and if it means refusal, why do not they just update the e-case to write "decision made".

The reason here is similar to your situation:

If the refusal happens before they start processing the application, when the e-case shows "received by the visa office", they update the e-case to show " visa office eligibility review complete" which means that the rejection happened during the intial stage before they start processing the application, and the applicant is eligible for a refund.

If the refusal happens after they start processing the application, when the e-case shows " In Process", they update the e-case to show " decision made", which means the application was processed and refused, and the applicant is no longer eligible to a refund.


The reasons of the refusal might be the same exactly either before or after they start the processing of an application. In this case, it depends on the visa officer in charge of the application, some of them refuse the applications before the processing begins, others refuse them after the processing begins with or without additional documents request. (they have the power to do so).


If you check the Buffalo check list, you will notice that it says:

"after you submit your application, it is your responsibility to notify this office and provide the appropriate supporting documentation.

The Visa Officer will assess your application on the basis of the information you have provided. The Officer is under no obligation to request information you have not provided."

The above sentence gives them the power of refusing any application for missing any documents needed to support the processing of an application without any warning, regardless the stage of the application.


Your case has been forwarded to LA. visa office as you mentioned above, i do not think the three of you got transfered to other visa office than Buffalo which means that your case might have passed the initial stage, and got refused after they started processing, i am sure that when you check your e-case, you will see "decision made", but your friends who got a refund will see "visa office eligibility review complete". (suppose that the e-case for all of you is updated on time)
