PR applications made on Humanitarian and Compassionate Considerations

Anyone familiar with these? I would appreciate advice on whether I have grounds for applying for PR this way.

So here's my situation, in fact-form:

I've been in Canada for the past 12 years as an international student, from the age of 12.

I'm graduating from a 4-year university in May.

Normally, I would be able to get the 3-year post-graduate work permit and then apply for PR as  Canadian experience class.

But my passport, which expires in September, cannot be renewed, as I am due for compulsory military service in the country of my citizenship.

And so the work permit, if issued, wouldn't allow me to stay beyond September.

I spent my adolescent and adult years in Canada, and thus feel very strongly that my life and future is here.

I know nothing about this situation but my common sense tells me that Canada would not interfere in another Countries rules, as long as there was no harm to that person.

Compulsory military service, is not a reason for a refugee claim and certainly from your post, you don't sound like someone that comes from a persecuted back ground. It must have cost a fortune for you to study in Canada these past 12 years, so therefore I am guessing you actually come from a privileged back ground.

Therefore, if I was you I would go back and do your service. Once that is done, you can then apply back to Canada , free from any National obligation and pursue your life here.

To clarify, Refugees and Humanitarian and Compassionate Grounds are separate classes. I need advice on the latter. I am NOT seeking to apply for refugee status.

The CIC website lists a few examples of Humanitarian and Compassionate Grounds, where I found the following excerpt: "... has been in Canada for such a long time, and is so established that he or she has in fact, if not in law, established residence in Canada and not abroad. These individuals are self-supporting, and have severed ties with their home country, and would suffer hardship if required to leave Canada."

My primary argument for my case is that I have spent the last twelve years laying down a foundation for a happy, meaningful life in Canada and that it would be extremely unfortunate, if not downright cruel, to be forced to return to a country where I have virtually no ties except for my mother. Consider:

I spent all of my adolescent and adult years in this country;
was educated as a Canadian (from gr.7 to post-secondary);
have important friend/relationships in Canada.

I mentioned the compulsory military service both as the reason why I can't extend my stay in Canada legally and apply for PR as CEC and as an example of a "hardship" I would be forced to endure upon my return.

You will go far with that attitude, please note that angelbrat qualified the post with "I know nothing about this situation".
Clearly making judgements based on quick observations, is all that is possible.
When you post on an open forum, you get opinions and judgements, the only choices that you have is to either refrain from posting, or ignore the replies..


FWIW I doubt that the hardship that you perceive, is a good reason, because others in your country fulfill the national obligation.
You may "feel very strongly that my life and future is here", however, you are a citizen of a country other than Canada.

hi ,             my medicals done in march 09 and back grounds over in ths jan 2011 .can u plz guide me how much more time imigration can take to finalize my pr process..??
            we filed case from canada,then i came to islamabad for process of pr .we r co-applicant,my wife 'care-giver and im with her on her aplicantion.'i get finalized in islamabad and she will get finalized in canada .we have 5 yrs old canadian born son too.our wait has become so so long as a "family". im so much concerned abt my fam .
in process for last 39 months .what do u judge that is it close to an end as medicals r done and back grounds checks r also done.thanks
