Dear friends,
Initially I came to Canada as a Temporary foreign worker and then extended my stay as a visitor. Is it possible to apply for PR (FSW) whilst in visitor status and currently residing in Canada?
Need advice.

Hi wilson, Thanks for your response. I am still confused....I will rephrase my question..... Can I apply for FSW PR while residing in Canada on Visitor status with my home country as my VO (on my PR application)? I have all the requirements to be eligible for FSW. I am not sending my application to Vergeville ( If Inland application means so). Thanks. MB

No, you cant apply from Canada becasue you are on visitor visa, but you can apply from your homecountry. read more on CIC manual or CIC website: http://www.cic.gc.ca/english/information/applications/skilled.aspOMM

Hi Omm, I am not on visitor VISA but on visitor STATUS....I believe the two are different categories. Will that change the eligibility? MB

Hi Omm, I went through the links that you provided ...thanks a lot. I have already gone through the links and eligibility conditions and I qualify but I could not find the information that precisely states that people having Visitor status and currently residing in Canada cannot apply for PR. As I understand the situation - PR VISA or Work VISA or any VISA is only required to ENTER any country (Canada in this case) but I am already in Canada and I do not see the connection of VISA and applying for PR (FSW) from within Canada. My VO will be my home country. If the PR visa is granted then it will be from my Home country and I will re enter Canada once I get it...is that not a possibility? I have observed many applicants do the same on this forum by sending (and receiving) the passports through friends/family for visa stamping. What am I missing here? I agree they were on WP and not Visitor status. MB

If applicant on work permit no need to apply at home country, they can apply from inside canada. but as I know visitor status can not apply from inside canada, you must be on work permit to apply inside canada, you can take advise of lawyer.

Its just that I am mailing my PR application to CIO (NS) while I am on visitor status and still residing in Canada and if there is a "Final eligibility" then the file will be transferred to the VO that I have requested (which is outside Canada). Why is that not possible... I could not find any reference for such condition. MB

right , its clear that you dont have valid work permit then you have to apply at your home country for visa, yes you can apply at CIO , but for stage 2 , you have to apply at home country, if you dont have valid work permit, if you have valid work permit right now then you can apply inside canada, but visitor status without work permit then you cant apply. simple logic, no need more material to read.

this is my take on this.....Well, if you are hell bent on applying now, you can post your application to CIO whiles in Canada but give details from your home country, like address, VO, phone etc. And you have to return to your home country probbably after receiving PER cos you definitely have to be in your home country for the process.

i got your point 2011maple...why cant apply since you are on vacation mode in Canda & still your VO will be fr your homecountry as long as you are eligible & legally admitted in your current residence regardless of your location I think you can apply. Just give the mailing address where you will stay permanently after your tourist visa expire bec it takes 8-16mos processing of FSW immig and all the correspondents will be sent to that address (maybe in your homecountry)
Just curious... how long is the validity of visitors visa in canada?!? in US it is 3,6mos & can be extended til 1yr.

Thanks so much for understanding the "Actual problem". I almost gave up... yes of course I will be giving my home country's mailing address and since I have a legal status as visitor in Canada, I HAVE to provide the Current Residential address which is Canada. Before my current status expires I will either have to extend my stay again as a Visitor/Worker/Student or go back to my Home country if not granted permission. In Canada the Visitor visa is issued according to the need of the applicant. Suppose you ask for 3m then you get a 3month visa otherwise the minimum sanctioned period is 6 months and can be 1yr too. You do have to provide the required documents to justify your stay with the needed funds to support yourself. Anyway, thanks again to everyone and I am sorry if I sounded repetitive in my query. MB
