PR and work permit questions

Hi everyone.

My wife and I had applied for PR in Jan 2011 from within Canada. I had to come back to the UK for a family emergency, and was planning to go back to Canada next week.

My wife told me yesterday that since I left Canada she has sort of moved on, and does not know if she wants to stay together with me. which has really devastated me.

As we have a PR application in process and if she does decide to leave me I know I will have to cancel my PR application.

But my question was am I still able to apply for a work permit after she had to cancel the PR application? and how long will it take for me to get one.

1) SHE has to cancel the PR application by withdrawing her sponsorship of said application.  Remember, with family class applications it is the sponsor who makes the applicant qualified by being eligible to sponsor them.  What you need to do is find out what has happened to the application, if she has made any move to have it withdrawn.

2) Work permits and how long they take to get depend on what kind you are applying for.  If you have a willing employer with a job offer, they must apply for a positive Labour Market Opinion (LMO) in order to get permission to hire you, and on that basis you can apply for a work permit.

If you don't have a specific job offer, you can apply for migration as a Skilled Worker if you have the correct training, qualifications and experience for a particular class of worker.  This is currently taking 42 months for processing. See here for more information on work permits.

I dont want to come there as a skilled worker or have a job offer from a company. I just wanted to apply for a temp work permit that maybe will allow me to work in Canada for at least a year. Just enough time to really prove to my wife that we do belong together.

You are visa exempt, so if you can meet the following condition, you qualify to apply for a work permit on entry to Canada:

Eligibility to apply as you enter Canada

You can apply for a work permit as you enter Canada, but only if you meet the following requirements:
•you are temporary resident visa exempt and
• your job does not need a labour market opinion from HRSDC (some exceptions apply) or
•you hold a labour market opinion from HRSDC.

You either need an LMO, or you need a job that doesn't require one. Jobs that do NOT need an LMO are listed at this link below.  If your skills qualify you under any of these categories, apply for a work permit on re-entry to Canada.

Hi thanks for getting back to me.

To be honest mate that jobs Ive had have been just a claims handler at a insurance company. I did graduate from a Canadian college and receive a diploma in business admin.

Im sorry but what does LMO mean?

No problem, just trying to help as best I can.

An LMO = Labour Market Opinion.  It is something an employer gets from the Human Resources and Skill Development Canada (HRSDC) which, when positive, says they can hire a foreign national to fill a vacant post because they cannot find a Canadian citizen or PR to fill the post and hiring the foreign national will not negatively impact the skills market.  With a positive LMO, the foreign national can then apply for a work permit to be hired by that employer.

Oh I see. well I cant realy do that in my case as my job was not exactly hard to do. It was more like data entry.

I think it will be extremely hard for me to come back there to work.

I just pray it all works out with my wife so I dont have to go through any of these stages.

Yep, work permits for Canada have extremely specific requirements for very specific industries.
