PMM - Badly need your opinion

Dear PMM,

I m the sponsored wife, applied for permanent residency under spousal family class. My sponsor is Permanent Resident. He recently came to spend family vacation with me and his parents and planning to stay for about 3 months until may 4, 2011.

My application is in process at singapore CHC for about 9 months. No news yet. Just "in process". Ordered Caips, saying File BF on 01-04-2011 and Medical is valid until 07 June 2011. PSDEC 1, rest all 0.

I am afraid, as my husband is currently here outside Canada, therefore, they are delaying the process to finalize my application.

Seeking your opinion what to do now. My husband is going back to Canada on 4th May. We already sent his confirmed eticket to Singapore office. They know that my husband will go back on the 4th May.

What you think is it the main reason, ( Because my sponsor is outside Canada now) they are not processing it? Looking forward to hearing from you soon.

If the sponsor is a Canadian, it doesn't make much of a difference, if he is PR then there could be problems, as PR sponsors are supposed to resi in Canada from the date of the sponsorship until the date the visa is issued.

(1) Subject to subsection (2), a sponsor, for the purpose of sponsoring a foreign national who makes an application for a permanent resident visa as a member of the family class or an application to remain in Canada as a member of the spouse or common-law partner in Canada class under subsection 13(1) of the Act, must be a Canadian citizen or permanent resident who

(a) is at least 18 years of age;

(b) resides in Canada; and

(c) has filed a sponsorship application in respect of a member of the family class or the spouse or common-law partner in Canada class in accordance with section 10.

My husband is flying back to Canada on 4th May. Since Singapore office has not responded yet anything, is it okay that my husband sends them the boarding passes, Passport Entry stamp after he returns ( On 5th May, Local time in Canada) so that Singapore office knows my husband has returned in Canada.

Is there any chance that before my husband flies for Canada, they issue refusal letter of my application. Won't they advice me that my sponsor should be in Canada right now to finalize my application?

Dont do this , they will send you a letter if they know that your husband isnt in Canada and request that you explain.Just tell your husband to go back and try to stay in Canada untill the process is finnished.

Try to relax plus your only half way through the process processing in singapora takes 18 months so dont expect anything anytime soon check this link:

Thanx for your post. Singapore office already know that my husband is currently with me until may 4th. He came on Jan 29, 2011. So it's 3 months.

Actually, my husband informed them when he came, just to be honest with them since if they tried to contact him in Canada ( by phone or letter), they would not get him. Ordered Caips note, nothing new information updated in CAIPS. All 0 except PSDEC 1.

Come to know in this forum that I am in danger that they might refuse me while my husband is here. I agree that he must reside at the time they process my application. Can't my husband visit me while in process? It sounds pathetic to me.

What do you think, they are waiting for my husband's return to Canada? ( They r not doing anything with my file Reference CAIPS, BF date is 01-04-2011)

My husband is going back on Apr 30 in stead of May 4th. How CHC Singapore will know that my husband returns in Canada.

Please, seeking your response since we are very much worried. Seems to us that our Boat is sinking at the Bay.

Since the visa office knows he is out of Canada, then yes, he should send proof he has returned to Canada when he does. It would have been better not to tell them he left Canada at all, but too late for that now.

He can come visit you, but long visits begin to look like he doesn't really plan to stay in Canada. I would say a three-month visit is too long, especially after another visit shortly before. A two week visit would be fine.

Like Canaianwoman said , since the visa office already know about him , than it would be best to show proof that hes going back and also an explanation letter indicating why he stayed there for a long period wont hurt in my opinion.Your best option right now is that your husband resides in Canada until the process is finalized even though its the hard way short visits are ok though.
