I currently have PPR request for me and my spouse . However, I have been charged for assult by my spouse. Things are working well between us and she would probably drop the charges but we are not sure if we want to live together or separate. I want to prepare for the worse situation.
Please suggest me to clarify following questions:
1) Would there be any problem while landing if my charges are dropped or if I am convicted. In other words, will there be backgroud check on me while landing. I am in US.
2) What should I do if we decide to divorce now? Should I send only my passport and write a letter that we will be divorcing and currently we are living separte.
3) Would there be any problem if we both send our passport and later we decide to get divorce?
4) Do I again need to show that I have at least CAD $13,837 ( fund required for couple) while landing.
Thank you friends for any suggestion.

There is no need to worry if you have already received PPR. Try to make things work out between you and your wife and everything is going to be fine. Regarding your conviction and Landing seniors can comment about it.

It is better to keep everytnig with her to be ok till you make the landing and you can divorce after 6 month-1 year from landing so that they will not cancel your visa becuase your wife give you points while you apply to CANADA. right? so to avoid fraud in marriage you should divorce her after 1 year from landing if everything are not being well with her.
Regarding the proof of fund ( POF ) it is better that you have it while you are landing becuase sometimes the immigration officer ask about it so you should have it wheather cash or check.
Thanks

Can I change my spouse to non-accompanying spouse at this stage and send only my passport?

I would suggest you to send a Personal Message to Qorax and ask him that. If you just send your passport, it wouldn't be accepted. If you both are separating than send that separation documents alongwith your passport.

Non-accompanying forms have also to be signed by your spouse however this could be an option. Try your best spur230 as any complications will only add further delays.

Allow me to add the following. In London VO specific instruction form, the following is mentioned:
"NON-ACCOMPANYING FAMILY MEMBERS DECLARATION (IF APPLICABLE):
If you have a spouse, common-law partner or dependent children and you do not intend to include them in your application for permanent residence, submit with your application a notarized statutory declaration stating your intention to proceed to Canada without your family members, and confirming that you understand that your family members must meet immigration requirements in their own right if they wish to join you in Canada."
If all other roads blocked for you, I suggest to try to issue the above letter, though the above paragraph referred to pre-submission stage, however nothing stops you tp pratice this right now as long as you are the principal applicant.
Cheers!

1. No background checks at the time of landing. 2. CHC might ask for your passports and ask for the cancellation of visa and will only issue a new visa if you haven't claimed any points for your wife. Be very careful here. 3. No problems. 4. You need to show the proof. The CBSA officer might ask for the legitimate proof

Spur230 please be very careful that you do not lie or misrepresent any material facts, if this is discovered the consequences are not good. I wish you well.
