Hi all,

One of friends is in Canada now for last 12 months. He is there in valid work permit through a very well known organization dealing with software services. He will be coming back to India this month. Is it possible to apply for the PR under FSW? If yes then which category to choose? He doesn't qualify for 0213.

What kind of help can you offer?Huh Do you need to actually see him to help him? I need suggestions from members who have applied under FSW2/3 category.

According to the eligibility criteria, your application is eligible for processing if:

1. you are a skilled worker who has at least one year of experience in one or more of the occupations listed here, OR
2. you have an offer of arranged employment, OR
3. you are a foreign national who has been living legally in Canada for one year as a temporary foreign worker or an international student.


does he not qualify under the category 3 above? if he does, then this is not necessary for him to apply under 0213. the "list of 38" is only for those who do not have arranged employment or who are not students and foreign workers in canada.

another thing... is he coming back to india for good? once he is back to india for good, would he still qualify under category 3? i guess not because he will no more be a temporary foreign worker living in canada once he has come back to india for good. but what if he applies under category 3 before coming back to india? thought i dont know if this is a do-able solution or not... but lets wait for someone to confirm if this is possible.

No, we dont need to see him in person but I am sure he'll know more about the system since hes been working there on a WP. I may be able to help but I need to ask him some specific questions first.
