I will be putting in my application under common-law and as I read the forms and instructions, it is really freaking me out!!! I now understand how it feels as posted by others in this forum. My problem is I have a difficult and unco-operative situation with my ex spouse. So I am not divorce as yet but have been separated with him more than a year. I do not have a "Separation Certificate" to submit with my application. Will my application be rejected?? Please help me Sad

I won't be rejected right away, the visa office will ask for the Original Divorce papers, so you might have to arrange at that time

Failure to produce that document at that time might be tricky then

It is not likely that your application would be rejected for lack of a Separation Certificate, they will likely ask for a separation agreement before your application is approved.
I was in a similar situation, I did not submit anything with my application, however they did request it. At the time I hadn't even filed for divorce, so I got a very simple 1 page separation agreement together, had her sign and notarize and I did the same. CIC accepted it, even though it wasn't any type of court generated document. Their main concern was the custody of my children. Do you have any children?

Oh dear, looks like its unlikely I will be able to get him to sign a separation letter  Sad We parted with lots of disagreements and bitterness. I have children but they are adults, 24 and 25 years old. Is not being a year apart amounts for separated? In fact I have lived apart 1 year before coming to Canada and that would amount to 2 years living apart.

It seemed that the main reason that Cic required my separation agreement was for the custody arrangments for the children. I would suggest submitting the application and see what they say. Make sure you do a "statutory declaration of common law" and send it in with your application and this will help avoid additional documents CIC would request.

Most likely they will ask for it later. In my case I have been divorced for almost 6 years, and I added in my Divorce Certificate. However about a month after sponsorship, the VO asked me for my original divorce petition. SO be prepared they may want it.

naku new life pareho tayo ng problem. sakin naman tinatago pa yung mga anak ko. sana meron tayong ibang parran para masolve ito.
