Hi everybody,
I have a friend who was a not approved refuge in Canada, after his refusal he got a ticket
and left Canada properly, after some time he met the woman of his dreams and they got
married, now adays his wife eligible (she's a nurse) to apply for skilled worker immigration.
The questions are, is my friend (as a husband of applier) about to have hard time through
the immigration process? would he be invited for the interview because of the refuge reason?
Is it possible that they can get rejection because of the husband?
Has anybody had deal with that?

I am no expert as I am still fairly new to these forums. But from what I have read in other threads the most important part will be the legitmacy (or genuineness of the marriage). I don't think the guy's previous refugee claim will be that important. it will only become important if after he left Canada he got married say 2 days afterwards and now his wife is applying. That looks funny--but not unheard of!! So, the refugee claim will be less important if a long time passed after he left the country before he got married and even better, how long he has remained married. If the wife meets the requirements to come to Canada as a skilled worker then, the husband's refugee previous refugee claim will not make a difference for her to come. It might be a little factor when she sponsors him.
Again, there are others on this site who know better than I, but I don't think the previous refugee claim will be the deal breaker. he left the country as he was required to, and as long as he has no criminal record or outstanding order for his arrest--then it shouldn't be that much of an issue.

His wife will not sponsor him. They will apply together as a married couple with her as the primary applicant.
You only sponsor a spouse when you are already a citizen or a PR at the time you get married. In that case you have to prove relationship to prove that you are not just getting that person a PR. It is completely different when a married couple applies for immigration together.

Okay, see??? I shouldn't offer advice when I don't know what i am talking about!! Leon is obviously correct. So Leon, I guess what the person wants to know is will the joint applicaiton be affected by the husband's previous refugee claim?

This post is double posted to some other topic as well and I already answered it there. I don't think the refugee claim will affect anything but if they want to immigrate, they should just apply. It's not like they can change the past anyway.
