Could any one please shed some light on whether I include my 19 yo daughter on my applications the more I read into it the more confused I become, I dont want to give misleading information and stuff up my application, she does not study or go to school she is in a defacto relationship and her fiance provides for her and they have a baby together so she looks after the baby at home, she has no plans ever to move to canada, but I am not sure if she is included in the information I have posted below Im confused if she falls into any type of A, B OR C, I know she is not included in type A OR C but B is what confuses me

Dependent children
Dependent children include:

Your dependent children
The dependent children of your spouse or common-law partner
The dependent children of your dependent children
Note: This also includes children whom you have joint or sole custody even if the children usually live with the other parent and will not join you in Canada.

Type A He or she is under the age of 22; and is single, (not married and not in a commonlaw relationship).
Type B He or she has been continuously enrolled and in attendance as a full-time student in a post-secondary institution accredited by the relevant government authority and depends substantially on the financial support of a parent either

since before the age of 22; or
since marrying or entering into a common-law relationship (if it happened before the age of 22).

Type C He or she is 22 years of age or older, has depended substantially on the financial support of a parent since before the age of 22 and is unable to provide for himself or herself due to a medical condition.

I think if she is your daughter then you have to include her on your application.

Hi

I think if she is your daughter then you have to include her on your application.

Not if she is a common/law relationship.  She would be shown on the IMM 5406 but not on the application.

hi PMM,

Not if she is a common/law relationship.  She would be shown on the IMM 5406 but not on the application.

ok so you are saying that I dont need to put her name down at all, now my next question is when I apply for applications from CIC what do I ask for is it IMM 5289 applying for permanent residence from within canada spouse or common law partner in canada class, or do I ask for Application to sponsor a member of the family class, because I will already be living in canada with my husband and we are applying from within canada which is compatible with the IMM 5289 forms, and the other application is more towards outland applications am I correct?
so my next question is do I mention her existance at all on any forms?

From what I understand, you're being sponsored as a spouse/common-law partner in Canada. In that case, these are the forms you will need:

http://www.cic.gc.ca/english/information/applications/spouse.asp

So yes, IMM 5289 and accompanying. You can print them out yourself or if you can't or would rather not, you can follow the link to ordering them on that page (bottom paragraph).

By saying application, i also meant IMM 5406 as it is one of the papers people need to fill out. I assume yre37768 understand what I mean. Sorry if caused any confusion.
