Author Topic: Please help - Departure Order (but already on WorkPermit)  (Read 523 times)

I have a work-permit in Canada and I am working here full-time. It is possible that I will get a departure order soon because I worked for another employer before my WP was transferred in the past. I know this happened to Rolyn Mirano

If I get a departure order, what are my options? I don't want to wait and have it converted to a deportation order. What are my options to return to Canada? My work-permit is valid until 2011 and I have a full-time job. If I get a departure order, is it possible to depart, get departure certificate and then come back (on same WP) ?

It'd cause me and my family significant financial hardship if I am unable to return to Canada. But I rather go through hardship than do something dubious (such as file a refugee claim when I've no grounds to do so) to simply delay my deportation. I rather depart and have option to come back to Canada. I've been here for several years now, and it's like home to me.

Do I have any options? Or do I just have to quit my job and leave forever?

If you work illegally, you take a chance.  You know you are working illegally and might get deported if they catch you.  Just hope they don't catch you.

Well, I mistakenly worked. I didn't even realize this until few days ago when I called CIC Call Center for some clarification while I was filling up my PR application.

If I do get a departure order, do I have any options? I don't want to make dubious claims (such as refugee filing etc.) because I don't have any legit grounds for it, and I am not interested in finding loopholes in the system. I made a mistake (unintentionally) and I admit it. I'd like to know if I'd have any options to seek relif if I am given a departure order. Can I explain my circumstances and request immigration officer to forgive me?

If they find out, you should go straight to an immigration lawyer and ask for advice.  I still don't understand how you can mistakenly work illegally though.

Talked to him already,He really did, long story basically thought When you file for renewal of Work Permit,You have implied approval like TRV,Good Faith though,He quit the same day he recieved denial.Basically a naive student.I will be assisting him since He is in BC.Cheers

He worked without permission and has been reported, so if he receives a departure order, which he likely will, he will be banned as well.  He can apply for restoration if the infraction was less than 90 days ago.

Not been reported. This happened more than 90 days ago. About 2 years ago. I am voluntarily reporting it myself. I didn't even know I had made a mistake until now when I started filling up application for PR and called CIC Call Center for some information.

Although it'd cause me significant hardship to leave Canada. I want to stay on the right side of the law. If I made a mistake (which I did), I rather own upto it, seek forgiveness, and comply with whatever decision they give me. Some people suggested filing for refugee etc but I am NOT going to file for anything that I don't have legit grounds for, in order to work the system with loopholes.

I spoke with BCGuy and he was very kind and offered to help me with this.
