Author Topic: Please guide me - my application - in process - work permit extension  (Read 341 times)

Dear Experts,

I came here to canada on student visa in 2008, i have completed my studies, now i am on PG work permit and was working.

I sent my application in Nov 2009 to buffalo office.They moved my application to NY office.
It says application processing started on Oct 27 th 2010


I do not see any change in the status. When i sent e-mail to cic, NY office i got reply saying my application is in queue for further
processing..

Will they see my application soon?(in couple of months)

now my open work permit is going to expire this nov 2011. Now i do not have job from last 2 months.

What should i do now?.Can anyone please suggest me?..



Does anyone applied in the same time frame and got PR already? How long does it take?

Could anyone please suggest me?. my PG work permit will expire in nov 2011. my immigration is in process..when i asked the status i got reply saying it's in queue for further processing..how to maintain my status after november as i do not have work now..i was working but my project has completed now, i have to start looking for another one to apply for work permit..or is there any other way like(visiting visa) to maintain the status and what are the chances since my immigration is in process..i want to be in the country until i know the status. please guide me.

Hi svs,

For you to maintain legal stay in Canada, you should apply for "Extension of stay" and change of status at least 1 month before your PG work permit expires.

You have to provide enough documentation to prove that you will be able to support yourself and your family financially ($10,000 CAD/yr) and other reasons. You may inform them that you have a PR application in process....dont forget to include evidence; or are enrolled in some courses. If you have children, you could mention that you want your children to complete the next academic year. Generally VO gives 6 months extension but you may get for a year (you have to indicate for how long you want the extension for).

The current paper processing time is 5 months but you need not worry because the interim time period that you would stay in Canada is called "Implied status" and is legal stay. You will either get a letter with extension granted or denied. If it is denied then you will have to leave Canada within a month.

If you do not apply before the expiry of Valid PG WP then you have 90 days to restore your situation to legal status. This should be avoided in all circumstances.

Thank you so much Mitali for your response, Can i enroll into a course again and apply for a study permit? actually i have study permit till 2012(initially i was enrolled into a 3 year course) but i had changed to 1 year course and i am on PG work permit currently. Will that previous study permit still valid? or do i need to apply for study permit again if i enroll into any course?(since the current status is PG work permit). please let me know. Thank You.

Hi svs,

Your study permit ceased to be valid when you got your PGWP. You will have to apply afresh for study permit.

How will you apply for new WP in Nov 11? You will have to go through the process of LMO in order to be employed. Your NOC - Multimedia Software Developer (NOC 9990.4) used to be LMO exmpt but now LMO is mandatory. So you will have to find an employer who is willing to employ you. You will not be able to work unless your employer gets a POSITIVE LMO in your favor. The current timeline is atleast 2-5 months depending on province.

If you are presently residing in Canada, then you will have to apply to a VO outside Canada for Study permit/ Work permit. Only Visitor permit (for people living in Canada) can be send to Vegreville, AB.

Thank you so much Mitali for your response. Can i apply for visitor visa incase if i do not find an employer.  what are chances of getting visitor visa? I am inside canada only.i have a reason to stay in canada because my immigration is in process (i got response from immigration saying my file is in queue for further processing. please let me know.

Experts, please help me in making decision to apply for change of status to work permit or study permit or visitor visa to maintain my status in canada until i know the decision about my PR application?
