If the spouse of a primary applicant overstays his visitors visa ( was admitted legally for 6 months) can the primary applicant still put him on the application as a dependant and apply through the buffalo office.?

Yes as long as the spouse is still in Canada,Are you petitioning as a Canadian PR or as Temporary worker

No i meant if the person overstay in the US..... both persons are in the US. The primary spouse is aplying for PNP Skill worker either Alberta /BC or New brunswick.. whichever is faster

I don't think they ask about dependents status except if they have been deported from anywhere.  You can enquire at the Buffalo visa office.
